The absence of an approved system to provide water and/or sanitation to an occupied <br /> residential structure renders the structure unfit for human habitation as defined by IPMC <br /> 108.1.3 which is a violation of IPMC 106.1, The record demonstrates said City ordinance <br /> was violated. <br /> 2. The presence of uncontained garbage that is not being stored in an approved covered <br /> container on the property are violations of IPMC 308.1. The record demonstrates said City <br /> ordinances were violated. <br /> 3. Occupancy of a structure without required water service is a violation of IPMC 505.1 and <br /> IPMC 505.3. The record demonstrates said City ordinance was violated. <br /> 4. Discarded junk, debris,household equipment, and articles of personal property in public <br /> view on the subject property are violations of EMC 8.20.020 (A) (C) and(G)and are public <br /> nuisances. The record demonstrates said City ordinances were violated. <br /> 5. Vegetation in the yards that exceeded the maximum allowed height of 12 inches is a <br /> violation of EMC 8.20.020 (E)and a public nuisance. The record demonstrates said City <br /> ordinance was violated. <br /> 6. The date, time,and place of this hearing were provided in the violation citation. The <br /> Respondents received proper notice of this matter. The Respondents failed to appear at this <br /> hearing and have not stipulated with the City to any other resolution of this matter. <br /> Therefore,the Respondents are in default. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above,it is hereby determined that <br /> the Respondents are in default and allowed violation of IPMC 106.1, IPMC 308.1,IPMC 505.1, <br /> IPMC 505.3, and EMC 8.20.020 (A)(C) (E)and(G) on the subject property and are hereby <br /> ordered to: <br /> 1. The Respondents must abate all violations of IPMC 106.1, IPMC 308.1, IPMC 505.1, IPMC <br /> 505.3, and EMC 8.20.020(A) (C) (E) and(G)on property located at 1832 Chestnut Street, <br /> Everett, Washington. <br /> 2.
