This procedure creates no rights for the benefit of third parties, including any proposers, and <br /> may not be enforced or subject to review of any kind or manner by any entity other than the <br /> RCO. Sponsors may be required to certify to the RCO that they have followed any applicable <br /> state and/or federal procedures or the above minimum procedure where state or federal <br /> procedures do not apply. <br /> B. Requirements for Federal Subawards. <br /> 1. For all Federal subawards except RTP projects, non-Federal entities (Sponsors) must follow 2 <br /> C.F.R§§200.318 General procurement standards through 200.326 Contract Provisions <br /> (2013). <br /> 2. For RTP subawards, Sponsors follow such policies and procedures allowed by the State when <br /> procuring property and services under a Federal award (2 C.F.R § 1201.317 (2013)). State <br /> procurement policies are in subsection A of this section. <br /> SECTION 17. TREATMENT OF EQUIPMENT AND ASSETS <br /> Equipment shall be used and managed only for the purpose of this Agreement, unless otherwise provided <br /> herein or in published funding board policies, or approved by RCO in writing. <br /> A. Discontinued Use. Equipment obtained under this Agreement shall remain in the possession of the <br /> Sponsor for the duration of the project, or RULES of applicable grant assisted program. When the <br /> Sponsor discontinues use of the equipment for the purpose for which it was funded, RCO may require <br /> the Sponsor to deliver the equipment to RCO, or to dispose of the equipment according to RCO <br /> published policies. <br /> B. Loss or Damage.The Sponsor shall be responsible for any loss or damage to equipment. <br /> C. Requirements for Federal Subawards. Except in the RTP, procedures for managing equipment <br /> (including replacement equipment), whether acquired in whole or in part under a Federal award or <br /> match for the award, until disposition takes place will, at a minimum, meet the following requirements <br /> (2 C.F.R§200.313 (2013)): <br /> 1. Property records must be maintained that include a description of the property, a serial <br /> number or other identification number, the source of funding for the property (including the <br /> Federal Award Identification Number), who holds title, the acquisition date, and cost of the <br /> property, percentage of Federal participation in the project costs for the Federal award under <br /> which the property was acquired, the location, use and condition of the property, and any <br /> ultimate disposition data including the date of disposal and sale price of the property. <br /> 2. A physical inventory of the property must be taken and the results reconciled with the property <br /> records at least once every two years. <br /> 3. A control system must be developed to ensure adequate safeguards to prevent loss, damage, <br /> or theft of the property. Any loss, damage, or theft must be investigated. <br /> 4. Adequate maintenance procedures must be developed to keep the property in good condition. <br /> 5. If the non-Federal entity is authorized or required to sell the property, proper sales procedures <br /> must be established to ensure the highest possible return. <br /> D. Requirements for RTP Subawards. <br /> 1. The subrecipient (Sponsor) shall follow such policies and procedures prescribed by and <br /> allowed by the State, as well as federal law and federal rules issued by the Federal Highways <br /> Administration and 2 CFR 200. <br /> RCO 16-1310D Revision Date: 1/11/2018 Page 18 of 37 <br />
