• <br /> 3. The dollar amount of federal funds for the project; and <br /> 4. The percentage and dollar amount of the total costs of the project that is financed by <br /> nongovernmental sources. <br /> SECTION 22. PROVISIONS FOR BOATING PROJECT GRANTS <br /> If requested by RCO, or required per state or federal law or rule with respect to any project or project element <br /> that supports recreational boating, Sponsor shall manage the project or project element per federal rules to <br /> include 2 C.F.R. Part 200, and place a United States Coast Guard (or other federal agency) logo and funding <br /> program information at the project site. <br /> SECTION 23. PROVISIONS APPLYING TO DEVELOPMENT, MAINTENANCE,RENOVATION,AND <br /> RESTORATION PROJECTS <br /> The following provisions shall be in force only if the project described in this Agreement is for construction of <br /> land or facilities in a development, maintenance, renovation or restoration project: <br /> A. Operations and Maintenance. Properties, structures, and facilities developed, maintained, or <br /> operated with the assistance of money granted by the board and within the project area shall be built, <br /> operated, and maintained according to applicable regulations, laws, building codes, and health and <br /> public safety standards to assure a reasonably safe condition and to prevent premature deterioration <br /> (WAC 286.13.130). It is the Sponsor's sole responsibility to ensure the same are operated and <br /> maintained in a safe and operable condition.The RCO does not conduct safety inspections or employ <br /> or train staff for that purpose. <br /> B. Document Review and Approval. Prior to commencing construction or finalizing the design, the <br /> Sponsor agrees to submit one copy of all construction and restoration plans and specifications to <br /> RCO for review solely for compliance with the scope of work to be identified in the Agreement. RCO <br /> does not review for, and disclaims any responsibility to review for safety, suitability, engineering, <br /> compliance with code, or any matters other than the scope so identified. Although RCO staff may <br /> provide tentative guidance to a Sponsor on matters related to site accessibility by persons with a <br /> disability, it is the Sponsor's responsibility to confirm that all legal requirements for accessibility are <br /> met even if the RCO guidance would not meet such requirements. <br /> 1. Change orders that impact the amount of funding or changes to the scope of the project as <br /> described to and approved by the funding board or RCO must receive prior written approval of <br /> the board or RCO. <br /> C. Control and Tenure.The Sponsor must provide documentation that shows appropriate tenure(such <br /> as landowner agreement, long-term lease, easement, or fee simple ownership)for the land proposed <br /> for construction. The documentation must meet current RCO requirements identified in the <br /> appropriate grant program policy manual as of the effective date of this Agreement and determines <br /> the long-term compliance period unless otherwise approved by the board. <br /> D. Nondiscrimination. Except where a nondiscrimination clause required by a federal funding agency is <br /> used,the Sponsor shall insert the following nondiscrimination clause in each contract for construction <br /> of this project: <br /> "During the performance of this contract, the contractor agrees to comply with all federal and state <br /> nondiscrimination laws, regulations and policies." <br /> RCO 16-1310D Revision Date: 1/11/2018 Page 20 of 37 <br />
