The Port entered into an Environmental Covenant with the State of Washington <br /> Department of Ecology (hereinafter "Ecology") on the 16th day of April, 2018, which such <br /> Environmental Covenant was recorded with the Snohomish County Auditor under Auditor's File <br /> No. 201804160540 (the"Environmental Covenant"). <br /> B. The real property that is subject to the Environmental Covenant is geographically <br /> described in Exhibit A attached hereto (the "Environmental Covenant Property") which such <br /> Environmental Covenant Property is a portion of the Northeast Quarter of the Southeast Quarter <br /> of Section 18, Township 29 North,Range 5 East, Willamette Meridian. <br /> C. The Environmental Covenant identified that the Environmental Covenant <br /> Property is the subject of remedial action under the Model Toxics Control Act ("MTCA"), <br /> Chapter 70.105D RCW. A portion of the Environmental Covenant Property is within the public <br /> right-of-way owned by the City and located beneath a concrete sidewalk located within that <br /> public right-of-way. This area of City public right-of-way is depicted between Reference Point <br /> Designations EC 18, EC 19, EC 20 and EC21 on Exhibit A attached hereto and hereafter the <br /> area between Reference Point Designations EC 18 through EC 21 on Exhibit A is referred to as <br /> "City Covenant Property". <br /> 1 <br />
