ORDINANCE NO. ,5,7'/- 7s` AN ORDINANCE providing for the levy and collection of excise taxes pursuant to Chapter 35.95 of the Revised Code of Washington upon persons within the City of Everett; limit- ing the use of the proceeds therefrom to the operation, 1 maintenance, and capital needs of the Everett Transit System; amending Section 2 of Ordinance No. 45-69 of the 2 City of Everett, and declaring an emergency to exist. 3 THE CITY OF EVERETT DOES ORDAIN: 4 Section 1 : That Section 2 of Ordinance No. 45-69 is hereby amended to read 5 as follows: 6 "Beginning with the month of January 1 , 1976, there is hereby levied upon all persons within the City of Everett who are 7 served and billed by the City for any one or more public utility services owned and operated by the City excise taxes 8 in the amounts and in the manner as follows: 9 A. On each person for each housing unit involved the sum of $1 .00 per month. 10 Where any structure, building, or portion thereof con- tains one or more housing units involved and the 11 occupants or tenants thereof are not billed for any public utility services furnished by the City to such 12 unit or units, the person who is billed for such ser- vice or services shall be deemed to be served and 13 billed therefor, and shall be billed and pay the monthly excise tax as herein levied and provided for 14 on each and every housing unit or units; provided, however, such amount so billed and collected shall not 15 exceed 90% of the total excise tax as above provided for and levied for such housing unit or units, which 16 is the average percentage of occupancy in housing units within the City of Everett. 17 18 B. On each person for each commercial unit involved the sum of $1 .00 per month. 19 Where any structure, building, or portion thereof con- 20 tains one or more commercial units involved and the occupants or tenants thereof are not billed for any 21 public utility services furnished by the City to such unit or units, the person who is billed for such ser- 22 vice or services shall be deemed to be served and billed therefor, and shall be billed and pay the 23 monthly excise tax as herein levied and provided for on each and every such commercial unit or units;24 pro- vided, however, such amount so billed and collected shall not exceed 90% of the total excise tax as above 25 provided for and levied for such housing unit or units, which is the average percentage of occupancy in com- 26 mercial units within the City of Everett. 27 C. On each person having employees the sum of $0.25 per employee per month; provided, however, that the 28 total sum payable by each person having employees shall not exceed $2,500 per month. 29 In the event that any person shall be subjected to more than one levy of the 30 excise tax under the definitions and provisions hereinabove set forth in this section, such person shall be liable for only one excise tax levy, which shall 31 be the highest tax levy for which he could be held liable. 32
