ORDINANCE NO. <br /> AN ORDINANCE prohibiting caterpillars ' <br /> infestation and declaring such <br /> infestation a public nuisance and <br /> providing for the abatement thereof <br /> and repealing Ordinance No. 4302 and <br /> declaring an emergency to exist. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: - Caterpillars prohibited. <br /> It is the duty of every person owning any premises in the <br /> City on which there are growing any fruit, shade or forest trees, <br /> or shrubbery of any kind, to keep the same free from caterpillars, <br /> and in the event it is found that any fruit, shade or forest <br /> trees or shrubbery have become infested with caterpillars, it is <br /> unlawful for the owner of any such premises on which there are <br /> growing any such trees or shrubbery to fail or neglect to promptly <br /> take and use such methods as may be necessary to effectually de- <br /> stroy the caterpillars, or in lieu of, destroy the trees or <br /> shrubbery. Any fruit, shade or forest trees or shrubbery be- <br /> coming infested with caterpillars is declared a public nuisance. <br /> Section 2 : - Abatement <br /> When in the judgement of the Director of Parks and Rec- <br /> reation that caterpillar infestation, on public or private pro- <br /> perty, is of such a degree as to affect other properties he shall <br /> immediately notify the person whose name appears on the current <br /> assessment role of the County Assessor, relating to the property <br /> involved, and the occupant of the property if said property is <br /> occupied. <br /> Said notice shall be given by first class mail notifying <br /> the persons involved that a public nuisance exists and stipu- <br /> lating a reasonable date for abatement. <br /> Should the owner and/or occupant of the property fail to <br /> take appropriate action within the time stipulated by the Park <br /> Director the Director shall have cause to take such action as <br /> deemed necessary to abate the public nuisance. <br /> The Park Director shall certify to the City Treasurer the <br /> actual cost incurred including administration and collection fee <br /> costs. If the work specified in this notice is performed by the <br /> City of Everett the costs of said work shall be charged to the <br /> owners or parties in interest of the real property on which <br /> said caterpillars are located and unless such costs have been <br /> previously paid by said owners or parties in interest such costs <br /> shall be levied and collected as a special assessment against <br /> said real property. <br />
