)90 <br /> • <br /> ORDINANCE NO. 06-‘.2 -7,1— <br /> AN <br /> S -7f <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF A <br /> PORTION OF RAILWAY AVENUE LYING NORTH OF HEWITT <br /> AND SOUTH OF CALIFORNIA AVENUE <br /> WHEREAS, by Resolution No. 998 of the City of Everett, <br /> the City Council has declared its intentions to vacate said <br /> street, and <br /> WHEREAS, the City Council of the City of Everett did by <br /> resolution duly adopted, fix the 9th day of April , 1975, at <br /> 10 : 00 a.m. of said day, for the hearing, and determination of <br /> said Resolution, and, <br /> WHEREAS , due and legal notice of the time and place of <br /> said hearing and determination of said Resolution has been <br /> given out in the manner prescribed by law, and <br /> WHEREAS, at the time and place fixed for hearing favorable <br /> statements and objections to the vacating of the herein- <br /> described street were heard and discussed, and, <br /> WHEREAS , it now appears to the City Council of the City <br /> of Everett, that the portion of said street resolved to be <br /> vacated should be vacated, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : <br /> All that portion of RAILWAY AVENUE as it exists in the <br /> plat of Swalwells First Addition to Everett according to the <br /> plat thereof recorded in Volume 2 of Plats , Page 103 , Records <br /> of Snohomish County, Washington, lying between the Easterly <br /> projected North line of Hewitt Avenue also known as U.S . High- <br /> way No. 2 as acquired by Washington State and the East line of <br /> said plat; togetherwith the unnamed alley in said plat lying <br /> between Block A and the East line of said plat and South of <br /> California Avenue previously known as 28th Street, and the <br /> Northwest line of Railway Avenue be, and the same is hereby <br /> vacated, SUBJECT to the following conditions and restrictions : <br /> That the City of Everett retains an easement to construct, <br /> operate, maintain, repair and replace all public utilities <br /> under, over and across all of said vacated property. The <br /> City of Everett further retains the right to grant to public <br />
