)90 • ORDINANCE NO. 06-‘.2 -7,1— AN S -7f AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF RAILWAY AVENUE LYING NORTH OF HEWITT AND SOUTH OF CALIFORNIA AVENUE WHEREAS, by Resolution No. 998 of the City of Everett, the City Council has declared its intentions to vacate said street, and WHEREAS, the City Council of the City of Everett did by resolution duly adopted, fix the 9th day of April , 1975, at 10 : 00 a.m. of said day, for the hearing, and determination of said Resolution, and, WHEREAS , due and legal notice of the time and place of said hearing and determination of said Resolution has been given out in the manner prescribed by law, and WHEREAS, at the time and place fixed for hearing favorable statements and objections to the vacating of the herein- described street were heard and discussed, and, WHEREAS , it now appears to the City Council of the City of Everett, that the portion of said street resolved to be vacated should be vacated, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : All that portion of RAILWAY AVENUE as it exists in the plat of Swalwells First Addition to Everett according to the plat thereof recorded in Volume 2 of Plats , Page 103 , Records of Snohomish County, Washington, lying between the Easterly projected North line of Hewitt Avenue also known as U.S . High- way No. 2 as acquired by Washington State and the East line of said plat; togetherwith the unnamed alley in said plat lying between Block A and the East line of said plat and South of California Avenue previously known as 28th Street, and the Northwest line of Railway Avenue be, and the same is hereby vacated, SUBJECT to the following conditions and restrictions : That the City of Everett retains an easement to construct, operate, maintain, repair and replace all public utilities under, over and across all of said vacated property.
