1 ORDINANCE N0.,30 ' 79 2 AN ORDINANCE providing for the vacation of 3 a portion of the Alley East of Commercial Avenue lying North of Howard Avenue. 4 WHEREAS, the City Council of the City of Everett has 5 accepted a petition signed by more than two-thirds of the 6 abutting property owners to vacate a portion of the herein- 7 after described alley, and 8 WHEREAS, the City Council of the City of Everett, did by 9 resolution, duly adopted, fixed the 10th day of April, 1974 , 10 at 10 a.m of said day for the hearing, and determination of 11 said petition, and 12 WHEREAS, due and legal notice of the time and place of 13 said hearing and determination of said petition has been given 14 by the City Clerk in the manner prescribed by law, and 15 WHEREAS, at the time and place fixed for hearing favorable 16 statements and objections to the vacating of the hereinafter 17 described alley were heard and discussed, and 18 WHEREAS, it now appears to the City Council of the City of 19 Everett that the portions of the hereinafter described alley 20 petitioned to be vacated, should be vacated, 21 22 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 23 Section. 1: 24 Beginning at the southwest corner of Lot 13 , Block 6, Pinehurst, according to the plat thereof recorded in 25 Volume 8 of Plats, on page 3, Records of Snohomish County, Washington; thence due west along the 26 Westerly produced South line of said Lot 13 a distance of 6 . 79 feet to an existing fence line; thence N30°03 ' 00"E 27 along said fence line a distance of 89. 56 feet; thence N 46°19 ' 00" E along said fence line a distance of 28 47 . 04 feet to the intersection with the Westerly pro- duced North line of Lot 15 in said Block 6, at a 29 point 5 . 72 feet West of the Northwest corner of said Lot 15; thence East on the Westerly produced 30 North line of said Lot 15 a distance of 5. 72 feet; thence S 35°16 ' 00" W along the east line of the 31 alley in said Block 6 to the point of beginning, 32
