Chapter 4.76) <br /> regulating unoccupied automobile service stations <br /> 2 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 3 <br /> 4 Section 1: <br /> 5 That a new section be added to Ordinance No. 233-73 and Ordinance <br /> 6 No. 290-74 (E.C.0 . Chapter 4.76) to read as follows: <br /> 7 "TIME EXTENSIONS: The aforementioned time limits may <br /> be extended in the following manner: <br /> 8 <br /> 9 (a) Any owner or lessee of an unoccupied service station <br /> may apply to the Board of Adjustment, as established in <br /> 10 Title 15 of the Everett City Code, for an extension of <br /> the one (1) year time limitation specified in this ordinance. <br /> 11 Such application should be made not less than forty-five (45) days <br /> prior to the end of the one (1) year period. <br /> 12 <br /> 13 (b) The board may authorize an extension of the time limitation <br /> specified herein for a period of not more than 120 days in <br /> 14 those specific cases wherein the board finds that one of the <br /> following facts or conditions exist: <br /> 15 <br /> (i) That the literal enforcement of the provisions or <br /> 16 requirements of the ordinance would cause undue and <br /> unnecessary hardship, including but not limited to economic hardship; <br /> 17 <br /> 18 (ii) That there is a real probability that the service <br /> station will re-open or be converted to another use <br /> 19 within one hundred twenty (120) days; <br /> 20 (c) In making its determination, the Board shall take into consideration <br /> the following factors: <br /> 21 <br /> (i) That the character and design of the service <br /> 22 station is compatible with the other structures and <br /> 23 buildings in the neighborhood and the general maintenance <br /> and housekeeping of the structure and property is of such a <br /> 24 nature that it is compatible with adjacent properties. <br /> 25 (ii) That the authorization of such time extension will not <br /> be materially detrimental to the public welfare or injurious <br /> 26 to property in its vicinity in which the property is located. <br /> 27 Section 2: <br /> 28 Notwithstanding any other provision of this ordinance or Ordinance No. <br /> 29 <br /> 233-73 and Ordinance No. 290-74 (E .0.0 .
