74,0 <br /> 35e 7)1 <br /> ORDINANCE NO. 2G, 741 <br /> AN ORDINANCE regulating the temporary placing of <br /> demolition and building materials on streets and <br /> repealing all ordinances in conflict. <br /> THE CITY OF EVERETT DOES ORDAIN as follows: <br /> Section 1: <br /> No person is authorized to temporarily place building or demolition <br /> materials on the street or sidewalk area during a structure's construction, <br /> repair or demolition unless a permit is obtained from the City Engineer; <br /> provided, however, every person to whom a permit is issued shall comply <br /> with the following conditions: <br /> (a) Not more than one-third of the street abutting the lot <br /> on which a structure is constructed, repaired or demolished <br /> shall be obstructed for motor vehicle traffic; <br /> (b) A temporary sidewalk of at least two feet in width shall <br /> be provided around said obstruction; <br /> (c) The obstruction shall be protected and guarded by <br /> sufficient barriers and warning devices so as to warn <br /> passersby of the obstruction and the person placing <br /> materials on the street or sidewalk area shall assume <br /> the liability for such barriers and warning devices. <br /> (d) The permittee shall post a $1, 000 surety bond to assure <br /> the City of Everett of permittee's full performance of all <br /> requirements under this permit. Permittee shall be <br /> responsible for negligent or non-negligent damaging by the <br /> permittee of property owned or used by the City of Everett <br /> further conditioned to save the City of Everett harmless <br /> from all claims and costs incurred as a result of granting <br /> the permit. <br /> (e) The permittee shall hold the City of Everett harmless from <br /> all liability and damages due to such use of street or sidewalk <br /> area and shall provide liability insurance coverage providing <br /> indemnity for and protection to the City of Everett. Said <br /> insurance policy shall be in the sum of one hundred thousand <br /> dollars for the injury or death of one person, three hundred <br /> thousand dollars for the injury or death of more than one person <br /> in any one accident and fifty thousand dollars for property <br /> damage. Every such policy of insurance shall continue to the <br /> full amount thereof notwithstanding any recovery thereon and <br /> shall provide that the liability of the insurer shall not be affected <br /> by the insolvency or bankruptcy of the insured. The policy shall <br /> be for the benefit of any and all judgment creditors. Each <br /> insurance policy required hereunder shall extend for the period <br /> covered by the license applied for and the insurer shall be obliged <br /> to give not less than ten days' written notice to the city clerk <br /> in the event of any change or cancellation. <br /> Section 2: <br /> The following ordinances and sections of ordinances are hereby <br /> repealed: <br />
