3 3 S - 7• r <br /> • <br /> ORDINANCE NO. / 7V <br /> 1 <br /> 2 AN ORDINANCE regulating competitive bidding. <br /> 3 <br /> 4 THE CITY OF EVERETT DOES ORDAIN: <br /> 5 <br /> Section 1: <br /> 6 <br /> Except as otherwise provided herein, purchases and contracts for <br /> 7 public works shall be by competitive bidding and let to the lowest responsive <br /> and responsible bidder. In determining "lowest responsible bidder," <br /> 8 in addition to price, the following elements shall be given consideration: <br /> 9 <br /> (a) The ability, capacity and skill of the bidder to <br /> 10 perform the contract or provide the service required; <br /> 11 (b) The character, integrity, reputation, judgment, experience <br /> and efficiency of the bidder; <br /> 12 <br /> 13 (c) Whether the bidder can perform the contract within the time <br /> specified; <br /> 14 <br /> (d) The quality of performance of previous contracts or <br /> 15 services; <br /> 16 (e) The previous and existing compliance by the <br /> bidder with laws relating to the contract or services; <br /> 17 <br /> 18 (f) Such other information as may be secured having <br /> a bearing on the decision to award the contract. <br /> 19 <br /> Section 2: <br /> 20 <br /> Competitive bidding shall not be required in the following <br /> 21 instances: <br /> 22 (a) Purchases or contracts for public work with an <br /> 23 expenditure of less than $2,000.00. <br /> 24 (b) Purchase made or contracts for public works entered <br /> into pursuant to a resolution by the City Council declaring <br /> 25 an emergency to exist. <br /> 26 (c) Contracts for personal or professional services involving peculiar <br /> 27 skill or ability where the performance of the contract depends <br /> on the skill and ability of the persons or company rendering the <br /> 28 service. <br /> 29 (d) Purchases or contracts where there is only one available <br /> source capable of supplying the subject matter of the contract. <br /> 30 <br /> 31 <br /> 32 <br />
