• <br /> ORDINANCE NO. r 7 - 7 / <br /> i AN ORDINANCE regulating the use, consumption <br /> and possession of liquor and amending sections <br /> 2 of existing ordinances to clarify statutory and <br /> court designations. <br /> 3 <br /> 4 WHEREAS, pursuant to the City of Everett's City Code revision, <br /> 5 <br /> it is found that sections in Chapter 6.32 of the present City Code contain <br /> 6 <br /> references to certain state statutes and courts which are outdated; <br /> 7 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN as follows: <br /> 8 <br /> 9 Section 1. That Section 3 of Ordinance No. 3067 (E .0 .0 . 6.32.030) <br /> 10 is hereby amended as follows: <br /> 11 "Any person who keeps or possesses liquor, including <br /> wine or beer, on premises conducted or maintained by <br /> 12 him as principal or agent, with intent to sell the same <br /> in violation of this chapter and R.C .W. Title 66, is guilty <br /> 13 of a violation of this chapter." <br /> 14 <br /> Section 2. That Section 9 of Ordinance No. 3 067 (E .0 .0 . <br /> 15 <br /> 6.32.090) is hereby amended as follows: <br /> 16 <br /> "If, upon sworn complaint of any person, it shall be made <br /> 17 to appear to the Everett District Court that there is probable <br /> 18 cause to believe that intoxicating liquor is being sold <br /> bartered, exchanged, given away, furnished or otherwise <br /> 19 disposed of, or kept in violation of this chapter, such Court <br /> shall issue a search warrant directed to a Civil Officer of <br /> 20 the State of Washington duly authorized to enforce or assist <br /> in enforcing any laws thereof, or to the Chief of Police or duly <br /> 21 authorized Police Officer of the City of Everett, or to an inspector <br /> of the Washington State Liquor Control Board, commanding <br /> 22 him to search the premises designated and described in such <br /> 23 complaint and warrant, and to seize all intoxicating liquors <br /> therefrom, together with the vessels in which they are contained, <br /> 24 and all implements, furniture and fixtures used or kept for the <br /> illegal sale, barter, exchange, giving away, furnishing, or <br /> 25 otherwise disposing of such liquors, and to safely keep the same <br /> and to make a return for said warrant within ten (10) days <br /> 26 following, all acts and things done thereunder, with a <br /> 27 particular statement of all articles seized and the name of the <br /> person or persons in whose possession the same were found, <br /> 28 if any, and if no person be found in possession of said articles <br /> the return shall so state. A copy of said warrant, together with <br /> 29 a detailed receipt for the property taken shall be served <br /> upon the person or persons found in possession of such <br /> 30 intoxicating liquor, furniture or fixtures so seized, and if <br /> no person be found in possession thereof a copy of the warrant <br /> 31 and receipt shall be left in a conspicuous place upon the <br /> 32 premises in which the same are found. All liquor, seized <br /> pursuant to such search warrant, shall upon final adjudication <br />
