• (i) Fire Prevention Review Board. In order <br /> • <br /> to determine the suitability of alternate materials and <br /> type of construction and to provide for reasonable inter- <br /> pretation of the provisions of this Code, there shall be <br /> and hereby is created a Board of Review, consisting of <br /> seven members who are qualified by experience and train- <br /> ing to pass upon pertinent matters. The Fire Chief shall <br /> be an ex-officio member and shall act as secretary of the <br /> board. The Fire Prevention Review Board shall be appoint- <br /> ed by the Mayor and shall hold office for four year <br /> staggered terms. The Board shall adopt reasonable <br /> rules and regulations for conducting its investigations <br /> and shall render all decisions and findings in writing <br /> to the Fire Chief with a duplicate copy to the appellant <br /> and may recommend to the City Council such new legisla- <br /> tion as is consistent therewith. <br /> Members serving on the Fire Prevention Review Board shall be <br /> the same individuals that are appointed to the Building Codes <br /> Board of Appeal as provided for in the Uniform Building Code. <br /> (ii) Steps on Appeal -- Any person upon whom <br /> such Fire Marshal Order has been served who desires to <br /> appeal the order therein set forth and review such order may <br /> do so, so long as such person shall comply with each and <br /> every step herein set forth, which jurisdictional steps are <br /> as follows : <br /> (a) File two copies of notice of appeal <br /> with the City Clerk of the City of <br /> Everett within five days after service <br /> of said Fire Marshal Order; and <br /> (b) Post the sum of $25 . 00 with the City <br /> Clerk to cover cost of appeal. <br /> (iii) In the event that any such person seeking a <br /> review before the Fire Prevention Review Board fails to <br /> comply with all of the steps herein set forth, then any <br /> member of said Fire Prevention Review Board or the City <br /> Attorney for the City of Everett may dismiss such appeal <br /> upon motion and if all of the steps for appeal have not been <br /> complied with, the appeal of such party shall be dismissed <br /> by the Fire Prevention Review Board. <br /> -8- <br />
