r ORDINANCE NO. -0d _7 1 2 AN ORDINANCE specifying the permit application 3 requirements for the manufacture, use, sale, display or transportation of fireworks, and limiting retail 4 sale of fireworks to "bona fide charitable non-profit organizations" and amending E.C .C. Section 7.40.310 5 (Section 23 of Ordinance No. 3882) . 6 THE CITY OF EVERETT DOES ORDAIN AS FOLLOWS: 7 Section 1: That Section 7.40.310 of the Everett City Code (Section 8 23 of Ordinance No. 3882) shall be amended to read as follows: 9 "7.40.310 Permit - Application: Any adult person or other 10 group desiring to do any act mentioned in Section 7.40.290 shall first make written application for a permit to the fire 11 marshal of the Everett Fire Department, which application 12 shall be in writing and which shall be made at least ten days in advance of the proposed display, if a public display of fireworks 13 is sought; provided, however, only 'bona fide charitable non-profit organizations' may make application for the retail sale of such 14 fireworks. 'Bona fide charitable or non-profit organization' means any organization duly existing under the provisions 15 of Chapters 24.12, 24.20 or 24.28 RCW, or any non-profit corporation duly existing under the provisions of Chapter 16 24.03 RCW for charitable, benevolent, eleemosynary, educational and 17 civic purposes only. The fact that contributions to an organization do not qualify for charitable contribution deduction purposes or that 18 the organization is not otherwise exempt from payment of federal income taxes pursuant to the Internal Revenue Code of 1954, as 19 amended, shall constitute prima facie evidence that the organization is not a bona fide charitable or non-profit organization for the 20 purposes of this section." 21 22 (4,./ 23 MAYOR ATTEST: 24 25 Cit Clerk 26 Passed: 1j 7 27 Valid: .— w-751 28 Published: 29 30 31 32
