.. // - 7,4 <br /> ORDINANCE NO. y 9 3- 74f <br /> AN ORDINANCE amending sections of both City <br /> ordinance and sections of the Everett City <br /> 1 Code (E .0 .0 .) whereby the criminal penalty provisions <br /> uniformly establish fines of not more than Five <br /> 2 Hundred ($500.00) Dollars or imprisonment not <br /> to exceed six (6) months or by both such fine and <br /> 3 imprisonment. <br /> 4 WHEREAS, during the process of reviewing and revising the <br /> 5 Everett City Code (E.C .C.) it has been found that due to state statutory <br /> 6 <br /> amendments the penalty provisions in the various City of Everett <br /> 7 <br /> ordinances and City code chapters are not uniform and are below the <br /> 8 <br /> maximum authorized by state statutes; <br /> 9 <br /> 10 WHEREAS, it would be in the best interest of the City of Everett to <br /> 11 establish uniform penalty provisions in accordance with the maximum penalties <br /> 12 specified by state statutes; <br /> 13 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 14 Section 1: In the sections of the City of Everett ordinances <br /> 15 <br /> and of the Everett City Code, (E.C .0 .) specified in Section 2 of this ordinance, <br /> 16 <br /> the penalties shall be amended as follows: <br /> 17 <br /> "Any person violating any of the provisions or failing <br /> 18 to comply with any of the mandatory requirements of <br /> 19 this ordinance [chapter] shall upon conviction of such <br /> violation or failure be punished by a fine of not more than <br /> 20 $500.00 or by imprisonment not to exceed six (6) <br /> months, or by both such fine and imprisonment." <br /> 21 <br /> Section 2: The amendment in Section 1 shall be applicable to the <br /> 22 <br /> following City ordinance sections or sections of the City code: <br /> 23 <br /> 24 Section 8 of Ordinance No. 4267 (E .C.C. Section 1.84.080) - Civilian <br /> Crossing Guards <br /> 25 <br /> Section 36 of Ordinance No. 3560 (E.C.0. Section 2.04.4201 <br /> 26 Gas Code <br /> 27 Section 32 of Ordinance 3735 as amended by Section 9(b) of <br /> 28 Ordinance No. 29-69 (E.C .0. Section 2.20.320(b) <br /> Sewer Connections <br /> 29 <br /> The third paragraph of Section 2 of Ordinance No. 4041 (E .0 .C. <br /> 30 Section 2.44.170 - Sign Code <br /> 31 <br /> 32 <br />
