• ORDINANCE NO - 7 • II AN ORDINANCE providing for claims for damages, 1 or injuries against the City arising out of tortious conduct and providing for the presentation, 2 examination, allowance or disallowance, and payment of such claims, and repealing 3 Ordinance No. 206-72 4 5 THE CITY OF EVERETT DOES ORDAIN AS FOLLOWS: 6 Section 1: 7 All claims for damages or injuries against the City arising out of 8 tortious conduct shall be presented in writing and filed with the Clerk of 9 the City of Everett within 120 days from the date that the damage occurred 10 or the injury was sustained. 11 Section 2: 12 All claims for damages or injuries against the City, provided for in 13 14 Section 1 hereinabove, shall accurately state the time, place, source, 15 nature and extent of the alleged damage or injuries, and give the actual 16 residence of the claimant by street and number at the date of presenting 17 such claim and for six months immediately prior to the time such claims 18 for damages accrued and shall be verified by affidavit of the claimant, or such 19 other person, as may be authorized by law to verify such claims to the effect 20 that the same is true. 21 If the claimant is incapacitated from verifying and filing his claim for 22 23 damages within the time prescribed, or if the claimant is a minor, or in case the 24 claim is for damages to real or personal property, and if the owner of such 25 property is a nonresident of such city or is absent therefrom during the 26 time within which a claim for damages to said property is required to be 27 filed, then the claim may be verified and presented on behalf of the claimant 28 by any relative or attorney or agency representing the injured person, 29 or in case of damages to property, representing the owner thereof. 30 31 32
