• <br /> ORDINANCE NO - 7 <br /> • II <br /> AN ORDINANCE providing for claims for damages, <br /> 1 or injuries against the City arising out of <br /> tortious conduct and providing for the presentation, <br /> 2 examination, allowance or disallowance, and <br /> payment of such claims, and repealing <br /> 3 Ordinance No. 206-72 <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN AS FOLLOWS: <br /> 6 Section 1: <br /> 7 All claims for damages or injuries against the City arising out of <br /> 8 tortious conduct shall be presented in writing and filed with the Clerk of <br /> 9 the City of Everett within 120 days from the date that the damage occurred <br /> 10 <br /> or the injury was sustained. <br /> 11 <br /> Section 2: <br /> 12 <br /> All claims for damages or injuries against the City, provided for in <br /> 13 <br /> 14 Section 1 hereinabove, shall accurately state the time, place, source, <br /> 15 nature and extent of the alleged damage or injuries, and give the actual <br /> 16 residence of the claimant by street and number at the date of presenting <br /> 17 such claim and for six months immediately prior to the time such claims <br /> 18 <br /> for damages accrued and shall be verified by affidavit of the claimant, or such <br /> 19 <br /> other person, as may be authorized by law to verify such claims to the effect <br /> 20 <br /> that the same is true. <br /> 21 <br /> If the claimant is incapacitated from verifying and filing his claim for <br /> 22 <br /> 23 damages within the time prescribed, or if the claimant is a minor, or in case the <br /> 24 claim is for damages to real or personal property, and if the owner of such <br /> 25 property is a nonresident of such city or is absent therefrom during the <br /> 26 time within which a claim for damages to said property is required to be <br /> 27 filed, then the claim may be verified and presented on behalf of the claimant <br /> 28 <br /> by any relative or attorney or agency representing the injured person, <br /> 29 <br /> or in case of damages to property, representing the owner thereof. <br /> 30 <br /> 31 <br /> 32 <br />
