0 <br /> 1 <br /> Section 14: Tax constitutes debt. Any tax due and unpaid under <br /> 2 <br /> this chapter and all penalties thereon, shall constitute a debt to Everett, <br /> 3 <br /> a municipal corporation, and may be collected by court proceedings in the <br /> 4 <br /> 5 same manner as any other debt in like amount, which remedy shall be in <br /> 6 addition to all other existing remedies. The right of recovery by the City <br /> 7 of Everett from the taxpayer for any tax provided hereunder shall be outlawed <br /> 8 after the expiration of three (3) years and the right of recovery against the <br /> 9 City of Everett because of overpayment of tax by any taxpayer shall be <br /> 10 <br /> outlawed after the expiration of three (3) years after which time the taxpayer shall <br /> 11 <br /> have no right of recovery against the City of Everett. <br /> 12 <br /> Section 15: Violations - Penalty. Any person violating <br /> 13 <br /> 14 or failing to comply with any of the provisions of this chapter or any lawful rule or <br /> is regulation adopted by the City Treasurer pursuant thereto, upon conviction <br /> 16 thereof, shall be punished by a fine in any sum not to exceed Three Hundred <br /> 17 Dollars ($300.00) , or by imprisonment in jail for a term not exceeding ninety <br /> 18 (90) days, or by both such fine and imprisonment. <br /> 19 <br /> Section 16: Severability. If any provision or section of this chapter <br /> 20 <br /> shall be held void or unconstitutional all other parts, provisions and sections <br /> 21 <br /> of this chapter not expressly so held to be void or unconstitutional shall <br /> 22 <br /> 23 continue in full force and effect. <br /> 24 Section 17 On the effective date of this ordinance, the provisions <br /> 25 of Ordinance No. 250-73 are hereby repealed. <br /> 26 <br /> 27 <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 -6- <br />
