ORDINANCE NO. 4,792-73 <br /> 1 AN ORDINANCE providing for the vacation <br /> of a portion of Paine Avenue, lying south <br /> 2 of 37th Street and north of Interstate 5 <br /> 3 WHEREAS, by Resolution No . 7/ of the City of <br /> Everett, the City Council has declared its intentions to <br /> 4 vacate such street, and <br /> 5 WHEREAS, the City Council of the City of Everett <br /> did by resolution duly adopted affix the 30th day of <br /> 6 May, 1973 at 10 a.m. of said day for the hearing and <br /> determination of said resolution, and <br /> 7 <br /> WHEREAS , due and legal notice of the time and place <br /> 8 of said hearing and determination of said resolution has <br /> been given by the City Clerk in the manner prescribed by <br /> 9 law, and <br /> 10 WHEREAS, at the time and place fixed for hearing <br /> favorable statements and objections to the vacating of <br /> 11 the herein-described street were heard and discussed, <br /> and <br /> 12 <br /> WHEREAS, it now appears to the City Council of the <br /> 13 City of Everett that the portion of said street resolved <br /> to be vacated, should be vacated, <br /> 14 <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 15 <br /> Section 1 : That portion of Paine Avenue lying <br /> 16 south of 37th Street and north of Interstate 5, <br /> be and the same is hereby vacated . <br /> 17 <br /> Section 2 : That the ordinance shall not become <br /> 18 effective until the owners of property abutting <br /> upon the street herein-described shall compensate <br /> 19 the City of Everett in an amount equal to one- <br /> half the appraised value of the street herein <br /> 20 described. <br /> 21 <br /> CITY OF EVERETT <br /> 22 <br /> 23r <br /> , J <br /> Rgbert C.
