assessment 1 Section 3 : That the cost and expenses of the improve- ment including, but not limited to, all necessary and inci- 2 dental expense or fees or property acquisition costs , shall be born by and assessed against the property in- 3 cluded in the district herein created. The cost and ex- pense of the improvement to be assessed against the prop- 4 erty, including the assessment district herein created, shall be assessed in accordance with the special benefits 5 derived from the improvement without regard to the zone and termini method of spreading assessments. The City 6 shall not be liable in any manner for any of the remaining expenses and costs of the improvement, except as otherwise 7 provided in Section 4 . 8 Section 4 : That the City Council of the City of Everett finds and declares that it is in the best interest of the 9 sewer maintenance fund of the City of Everett to connect the herein-created improvements to existing City trunk lines in 10 74th Street Southwest by a gravity lateral line in lieu of the construction of a sewer lift station and pressure line 11 connection, thereby saving the sewer maintenance fund of the City of Everett certain undetermined costs . Accordingly, 12 the City of Everett shall pay out of the sewer maintenance fund the sum of $30 , 000 , which is estimated to be the ex- 13 cess cost of the lateral gravity line from Lot 28 Plat of Evergreen Glen to the existing sewer in 74th Street Southwest 14 over the cost of a lift station and pressure line. Said payment by the City may be subject to adjustment by ordi- 15 nance of the City Council upon determination of actual costs . 16 Section 5 : An amount of $30 , 000 is hereby appropriated from unanticipated revenues from the sewer revenue funds of • 17 the City for the purpose of contributing said amount for the construction of a lateral gravity line in lieu of lift sta- 18 tion and pressure lines as set forth in Section 4 . 19 Section 6 : In the event that funds from grants or sources other than funds from the City of Everett become 20 available for the hereinafter-described Local Improvement District such funds will be used to defray some of the cost 21 of the improvement to the property within the Local Improve- ment District hereinafter-described. 22 Section 7 : That there is hereby established a Local 23 Improvement District to be known as "LOCAL IMPROVEMENT DISTRICT NO. 696 " which district shall include the following- 24 described property located in Everett, Snohomish County, Washington : 25 The plat of Evergreen Glen as recorded in Volume 18 26 of Plats , Page 6 , Records of Snohomish County, Wash- ington. DISTRICT 27 r Section 8 : That a special/ fund is hereby created to 28 be known as "LOCAL IMPROVEMENT FUND NO. 696 which shall consist in the aggregate of the several amounts levied, 29 assessed and collected on the several lots , tracts , and parcels of land in said Local Improvement District and 30 the proceeds of the sale of the bonds or installment notes in said district for the purpose of defraying the costs 31 and expenses of such improvement out of said funds shall be paid the bonds or installment notes , the interest 32 thereon and the entire cost of such improvement.
