The leases typically require the tenant to maintain the interior of the premises in good order,
condition and repair while placing the obligation for structural repairs and replacements on the
landlord. The tenant's maintenance and repair obligations extend to maintenance and repair of the
electrical systems and facilities in the premises, requiring the tenant to keep those facilities and systems
in good order, condition and repair. No lease requires the tenant to use a licensed electrical contractor
for any of that repair and maintenance work. Of course, if applicable building codes require the use of a
licensed electrical contractor, Bartell would be obligated to comply with the building codes but building
codes do not require use of a licensed electrical contractor for normal maintenance and repair such as
replacement of ballasts.
Please let me know if this addresses your concerns.
Very truly yours,
Daniel P.
