(2). <br /> Exhibit 12 Exhibit List dated February 16, 2017 <br /> Based upon a review of the administrative hearing record, the following Findings of Fact <br /> and Conclusions of Law hereby constitute the basis of the decision of the Everett <br /> Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Shawn B. Brewer, Respondent, is the owner of property at 1913 23rd Street, <br /> Everett, Washington (property) that is in an R-2, Single Family Medium Density <br /> Residential zone as established by the City of Everett. (Exhibit#10, Snohomish <br /> County Assessors Record dated February 9, 2017) (Exhibit#11, Go Sync Maps) <br /> 2. On September 29, 2016, approximately 5 months prior to the hearing date of the <br /> instant violation, an Order was issued by the Everett Hearing Examiner finding that <br /> the Respondent violated ordinances of the City of Everett relating to nuisance <br /> ordinances and required permits for construction activity of the City of Everett. The <br /> Order required the Respondent to maintain the property free of nuisances and <br /> obtain final approvals from the City of Everett Building Division for construction work <br /> completed on the exterior of the residential structure on site. The Respondent was <br /> present at the hearing. (Exhibit#8, Final Findings of Fact, Conclusions of Law and <br /> Order of the Hearing Examiner Case #CE16-0475 dated September 29, 2016) <br /> (Testimony of Code Enforcement Officer Keirsey) <br /> 3. On December 21, 2016, Detective Molly Spellman, Snohomish County Regional <br /> Drug Task Force, forwarded photographs of the interior of the residential structure <br /> on the property to the City of Everett Code Enforcement unit for review. The <br /> photographs depicted extensive construction alterations that were being completed <br /> throughout the residence. On January 6, 2017, City of Everett Code Enforcement Officer Kevin Fagerstrom <br /> conducted an inspection of the property and observed and photographed evidence <br /> of electrical system work being conducted on the residential structure. Upon <br /> research of City records, Officer Fagerstrom determined that no permits had been <br /> applied for, or, obtained for the construction alterations conducted on the interior of <br /> the residential structure on site or additions to the electrical system. On January 6, 2017, the City issued the Respondent a violation citation as a repeat <br /> violator for violations of International Property Maintenance Code (IPMC) 106.1 <br /> Unlawful Acts as adopted by EMC 16.005.010; IPMC 108.1.4 Unlawful Structure as <br /> adopted by EMC 16.005.010 and International Residential Code (IRC) RI05.1 <br /> Permit Required as adopted by EMC 16.005.010. Copies were mailed to the <br /> Respondent via first class and certified mail to the Respondents last known address <br />
