1 1. The contestant actively participates; 2 2. The outcome depends in a material degree upon the skill of the 3 contestant; 4 3. Only merchandise prizes are awarded; 5 4. The outcome is not in the control of the operator; 6 5. The wagers are placed, the winners are determined, and a 7 distribution of prizes or property is made in the presence 8 of all persons placing wagers at such game; and 9 6. Said game is conducted by a bona fide charitable or nonprofit 10 organization, no person other than a bona fide member of 11 said organization takes any part in the management or 12 operation of said game, including the furnishing of equip- 13 ment, and no part of the proceeds thereof inure to the 14 benefit of any person other than the organization conducting 15 such game or said game is conducted as part of any agricult- 16 ural fair as authorized under chapters 15. 76 and 36. 37 RCW. 17 (g) "Bona fide charitable or nonprofit organization" means any organiza- 18 tion duly existing under the provisions of chapters 24. 12, 24. 20 or 19 24. 28 RCW, any agricultural fair authorized under the provisions 20 of chapters 15. 76 or 36. 37 RCW, or any nonprofit corporation duly 21 existing under the provisions of chapter 24. 03 RCW for charitable, 22 benevolent, eleemosynary, educational, civic, patriotic, political, 23 social, fraternal, athletic or agricultural purposes only, which 24 has been organized and is operated primarily for purposes other 25 than the operation of bingo games, raffles, amusement games, 26 and which received not more than twenty thousand dollars or 27 twenty-five percent of its gross receipts, whichever is the greater, 28 in any calendar year from the operation of bingo, raffles, amuse- 29 ment games, but these limitations on receipts shall not apply to 30 any organization which conducts only one raffle per calendar year, 31 the total gross income from which does not exceed twenty thousand 32 dollars, and -which does not conduct bingo games and/or amuse- -3-
