National Alliance for Recovery Residences—Recovery Residence Quality Standards; Code y; <br /> of Ethics, offered by Appellants <br /> Upon consideration of the argument,testimony, and exhibits submitted,the Hearing Examiner <br /> enters the following findings and conclusions. <br /> FINDINGS <br /> f. <br /> 1. On July 27, 2016,Appellants submitted a building permit application to correct 1 <br /> unpermitted interior work done by a previous owner of the existing roominghouse at 2901 <br /> Everett Avenue' The subject property is zoned R-4,Multiple Family High Density,with a i <br /> Core Residential Overlay. This zoning does not limit the number of bedrooms in a <br /> roominghouse so long as a minimum of one off-street parking space is provided per <br /> bedroom. Everett Municipal Code (EMC)EMC 19.34, Off-Street Parking, Table 34-1; <br /> Exhibits 1 and 6. <br /> 2. The City of Everett Planning Department reviewed the building permit application and <br /> determined that the number of rooms in the roominghouse would have to be limited to the <br /> number of parking stalls,per Off-Street Parking Table 34-1. As a result,the Appellants <br /> modified the site plan and floor plan layout to meet zoning code requirements. The <br /> building permit was issued for a 10-room roominghouse on September 20, 2016(permit - <br /> . number BW1607-004) and is still in active status. The approved site plan shows the 12,000 <br /> square foot lot containing 2,192 square feet of building coverage and 10 surface parking 7 <br /> stalls. Exhibits 1 and 4. <br /> i <br /> 3. On.January 3, 2017,the Appellants applied for a reasonable accommodation to allow the 1 <br /> use of up to seven additional rooms in the roominghouse without on-site provision of <br /> additional parking. The narrative submitted with the application indicated the following k <br /> information(paraphrased/abbreviated): The certificate of occupancy allows up to 24 <br /> persons to reside on-site. The special accommodation was requested for "residents <br /> suffering from illness, addiction,mental health issues, and physical damage caused by f <br /> physical stresses and/or injuries." (Exhibit 5,page 2.) The narrative indicated that the <br /> majority of residents and potential residents cannot drive for various reasons, including <br /> physical and mental disabilities and DUI issues. With the current 16 residents,the number <br /> F <br /> of vehicles parking on the site is five. The narrative asserted that with seven additional i. <br /> rooms,the number of parking stalls proposed for resident use would be seven. No use of <br /> street parking was proposed. The narrative stated that the roominghouse has two or fewer f <br /> visitors per day. The facility is intended to provide transitional housing of between three ; <br /> and 24 months duration for"clean and sober" individuals with various vulnerabilities that ti <br /> make it difficult to maintain their own housing.
