Minka dated May 9, 2011 <br /> Exhibit 15 Email from Katie Rathbun dated January 28, 2013 <br /> Exhibit 16 Email from Rania Elkhatib dated February 1, 2013 <br /> Exhibit 17 Proposed Order as submitted by the City of Everett Code <br /> Enforcement Unit dated February 7, 2013 <br /> Exhibit 18 Exhibit List dated February 7, 2013 <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions of Law hereby constitute the basis of the decision of the Everett Violations <br /> Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Patrick A. Parson, Respondent, is the owner of record of property located at 1715 <br /> Lombard Avenue, Everett, Washington (property). The property is in an R-2 Single- <br /> Family Detached Medium Density zone as established by the City of Everett. <br /> (Exhibit#6, Snohomish County Assessors Record dated January 17, 2013 for <br /> Parcel 00438235100700) (Exhibit#7, Snohomish County Assessors Record dated <br /> January 17, 2013 for Parcel 00438235100701) (Exhibit#8, Go Sync Map) <br /> 2. Although the Respondent had intended to surrender the property in a bankruptcy <br /> action on December 30, 2010, the bank holding the mortgage had not taken <br /> possession of the property and it remains in the Respondent's name. The <br /> Respondent provided City of Everett Code Enforcement(ECE) Officer Wathen a <br /> copy of the United States Bankruptcy Court Chapter 7 Individual Debtor's Statement <br /> as evidence of his initial intent to surrender the property back to the bank. (Exhibit <br /> #5, United States Bankruptcy Court Individual Debtor's Statement of Intention dated <br /> December 30, 2010) (Testimony of Code Enforcement Officer Wathen) <br /> 3. There are two residential structures on the property. The main structure situated at <br /> the front of the property, is vacant and physically secured. It was declared <br /> condemned by the City and posted as such on October 29, 2012 due to lack of <br /> utilities. A second single family-residence on the property is located on the rear of <br /> the property and is currently occupied.
