5 to <br /> (1) Increasing the number of dwelling units further above the maximum allowed by <br /> the zoning code. <br /> Conclusions of Law Based on Above Findings: <br /> 1. Alterations to a single family residence without required approvals and permits is a <br /> violation of IRC R113.1 as adopted by EMC 16.005.010. <br /> 2. The single-family residence was altered and occupied as two separate dwelling <br /> units in violation of IPMC 108.1.4 as adopted by EMC 16.005.010. <br /> 3. Expansion of a nonconforming use and increasing the number of dwelling units <br /> above the maximum allowed by the zoning code is a violation of <br /> EMCI9.38.03(D)(1). <br /> 4. The use of the structure for anything other than a single family residence does not <br /> comply with the City zoning code is illegal and shall be brought into compliance with <br /> the provisions of the zoning code. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent is in violation of IRC R113.1, IPMC 108.1.4, <br /> EMC19.38.03(D)(1), and is hereby ordered to: <br /> 1. The Respondent and/or it's successors shall abate all violations of IRC R113.1 as <br /> adopted by EMC 16.005.010 alterations to a single family residence without <br /> required permits and approvals, IPMC 108.1.4 as adopted by EMC 16.005.010 <br /> unlawful structure, and EMC 19.38.030 (D)(1) expansion of a nonconforming use on <br /> the property located at 1715 Lombard Avenue Everett, Washington. <br /> 2. All abatement of the violations on the above mentioned property shall be completed <br /> prior to further occupancy of the residence at 1715 Lombard Avenue, Everett, <br /> Washington. Cleanup and abatement shall include: <br /> a. The Respondent and/or its successors shall apply for and obtain all of the <br /> necessary and required permits to bring the property into compliance with the <br /> EMC and Everett Land Use Code. All work must be completed and inspected <br /> and approved by the City of Everett Building Division prior to occupancy. <br /> 3. If the Respondent and/or it's successors fail to abate the identified violations as <br /> directed by this Order, the City of Everett is authorized to undertake and complete <br /> the abatement in conformance with the provisions of the Everett Municipal Code, <br /> Chapter 1.20, at the full expense of the owner, which shall be in addition to the fines <br /> as imposed herein. The City may act without further order or direction of the <br /> Violations Hearing Examiner. <br />
