6. Until December 31,2013,not have violated RCW 39.04.370 more than one time as determined <br /> by the department of labor and industries. <br /> The Contract Documents shall apply to Subcontractors and Suppliers as if each had signed the Contract <br /> with the Owner. Contractor shall include the provisions of these Contract Documents or a"flow down" <br /> clause in each contract with Subcontractors and Suppliers. <br /> 4.4. RESPONSIBILITIES <br /> 4.4.1. Subcontractors,Manufacturers and Suppliers <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of Subcontractors, <br /> manufacturers, Suppliers and their employees. <br /> 4.4.2. Contractor's Employees <br /> The Contractor shall be responsible for the adequacy,efficiency and sufficiency of its employees. <br /> Workers shall have sufficient knowledge, skill and experience to perform properly the Work assigned to <br /> them. <br /> 4.4.3. Payment for Labor and Materials <br /> The Contractor shall pay and require its Subcontractors to pay any and all accounts for labor including <br /> Worker's Compensation premiums, State Unemployment and Federal Social Security payments and other <br /> wage and salary deductions required by law. The Contractor also shall pay and cause its Subcontractors <br /> to pay any and all accounts for services, Equipment,and materials used by him and its Subcontractors <br /> during the performance of Work under this Contract. The Contractor shall pay such accounts as they <br /> become due and payable. If requested by the Owner,the Contractor shall promptly furnish proof of <br /> payment of such accounts to the Owner. <br /> 4.4.4. Attention to Work <br /> The Contractor, acting through its representative, shall give personal attention to and shall manage the <br /> Work so that it shall be prosecuted faithfully and completed under the Project schedule. When its <br /> representative is not personally present at the Project Site, its designated alternate shall be available and <br /> shall have the authority to act in matters relating to this Contract. <br /> 4.4.5. Safety <br /> The Contractor alone shall be responsible for safety on the job Site, including,but not limited to,the <br /> safety of its and its Subcontractor's employees. The Contractor shall maintain the Project Site and <br /> perform the Work in a manner which meets the Owner's responsibility under statutory and common law <br /> for the provision of a safe place to work. , <br /> 4.4.6. Threats,Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees,or any other <br /> agents to threaten bodily injury or property damage,to intimidate or attempt to intimidate any person,or <br /> to assault or physically harass any person. Forbidden conduct includes,but is not limited to,threatening, <br /> appearing,or actually doing any of the following: pushing, shoving,striking,physically blocking a person <br /> or a person's vehicle,vandalism, malicious mischief,or any other act that a reasonable person would <br /> understand be intended to intimidate, cause personal injury,or cause property damage. Contractor shall <br /> remove from the job site any person reasonably under its control or direction who the Contractor or <br /> Owner reasonably believes violated this section. The lack of a request from the Owner or Owner's <br /> Representative to the Contractor to remove someone from the job Site,does not relieve the Contractor <br /> from its obligation to remove someone. <br /> 4.4.7. Weapons Forbidden <br /> Contractor shall not allow its employees,its Subcontractors, its Subcontractors' employees, or any other <br /> agents or representatives to carry or possess, openly or concealed,explosives or weapons on the job Site, <br /> General Conditions—007200-12 <br /> 1 <br />
