ORDINANCE NO. / 7 Y <br /> 1 AN ORDINANCE amending the Traffic Code of the <br /> City of Everett by establishing penalties for which <br /> 2 fines only shall be imposed and general penalties <br /> for which jail sentences or fines or both such <br /> 3 fine and imprisonment may be imposed, and amending <br /> Section 303 (ECC 46. 64. 050) of Ordinance No. <br /> 4 123-71) and declaring an emergency to exist. <br /> 5 WHEREAS, the Supreme Court of the United States has ruled that a <br /> 6 court appointed attorney shall be provided for all indigents faced with <br /> 7 criminal prosecution under misdemeanors for which a risk of imprisonment <br /> 8 may result, and <br /> 9 WHEREAS, the City Council of the City of Everett finds that imprison- <br /> 10 ment is not a suitable disposition with regard to violations of the traffic <br /> 11 code except only with regard to certain serious violations such as driving <br /> 12 while intoxicated, driving on suspended license, reckless driving and <br /> 13 hit and run, <br /> 14 NOW, THEREFORE, 'III E CITY OF EVERETT DOES ORDAIN: <br /> 15 Section 1: <br /> 16 "General Penalty <br /> 17 Any person who shall violate or fail to comply with any of the provisions <br /> of this title, or who shall counsel, aid or abet any such violations <br /> 18 or failure to comply, except parking and parking meter violations <br /> and other violations for which penalties are specifically provided <br /> 19 elsewhere in the traffic code, shall be deemed guilty of a traffic <br /> offense, and upon a finding of guilty, where no other penalty or <br /> 20 punishment is provided herein, shall be punished by a fine in any <br /> sum not exceeding $500. 00; provided, however, that any person who <br /> 21 shall violate or fail to comply with Section 10 of Ordinance No. 123-71 <br /> (ECC 46. 02. 110) False Representations; RCW 46. 20. 420 - Driving <br /> 22 on Suspended License, as adopted under Section 110 of Ordinance <br /> No. 123-,71 (ECC 46. 20. 420); RCW 46. 52. 010 - Duty on striking <br /> 23 unattended car or other property and RCW 46. 52. 020 - Duty in case <br /> of injury to or death of person or damage to attended vehicle <br /> 24 and RCW 46. 52. 030 - Accident Reports as adopted under Section <br /> 170 of Ordinance No. 123-71 (ECC 46. 52. 010-46. 52. 030); <br /> 25 RCW 46. 61. 500 - Reckless driving as adopted under Section <br /> 221-B of Ordinance No. 123-71 (ECC 46. 61. 506) - Operating <br /> 26 under the influence of intoxicants or drugs - Chemical analysis, <br /> tests, presumptions, penalties; RCW 46. 61. 510 - Persons under <br /> 27 the influence of drugs and RCW 46. 61. 515 - Driving while under <br /> the influence of intoxicating liquor or drugs - Penalties as adopted <br /> 28 by Section 223 of Ordinance No. 123-71; Section 29b of Ordinance <br /> No. 123-71 (ECC 46. 61. 940) - Tampering with meters - Unlawful; <br /> 29 Section 296 of Ordinance No. 123-71 (ECC 46. 61. 945) - Depositing <br /> slugs - Unlawful; and RCW 46. 64. 020 - Non-appearance after <br /> 30 written promise - Misdemeanor as adopted under Section 302 <br /> 31 <br /> 32 <br />
