9.3 Transactions Not Related to Public Transportation. The provisions of this Agreement assume <br /> that all load and use transactions related to the ORCA System are related to public transportation. <br /> 9.4 Sales Transactions Processing. Except as otherwise specified below, the ROOT shall be the <br /> merchant of record for all sales of ORCA Cards and ORCA Products processed through the ORCA <br /> Central Payment Gateway. Credit or debit card fees charged for all transactions processed through the <br /> ORCA Central Payment Gateway will be regional costs, shared by the participating agencies in <br /> accordance with applicable operating shares. <br /> 9.4.1 Agency sales channels include: <br /> 9.4.1.1 Over-the-counter Transactions. For the purchase of products at Agency <br /> customer service offices using credit or debit cards will be processed through <br /> the ORCA Central Payment Gateway with the exception of sales processed by <br /> Washington State Ferries. If an Agency receives payment for ORCA Cards <br /> and/or ORCA Products in the form of cash, check, or money order, the Agency <br /> shall deposit such payments into the Agency's Settlement Account for <br /> allocation under this Agreement. The transacting Agency shall bear the risk of <br /> fraud, dishonored checks for insufficient funds. <br /> 9.4.1.2 Vending Machine (VM) Transactions. For the purchase of products at vending <br /> machines using credit or debit card will be processed through the ORCA <br /> Central Payment Gateway. Payments made in the form of cash shall be <br /> deposited into the account held by the ROOT using an armored car revenue <br /> services agency. <br /> 9.4.1.3 Call Center Transactions. For the purchase of products at Agency call centers, <br /> using credit or debit cards, will be processed through the ORCA Central <br /> Payment Gateway. <br /> 9.4.1.4 Mail Transactions. The Regional Service Provider operating the Regional Mail <br /> Center will process all mail transactions. Payments for ORCA Cards or <br /> Products using credit or debit cards will be processed using the ORCA Central <br /> Payment Gateway. If an Agency receives payment for ORCA Cards and/or <br /> ORCA Products in the form of cash, check, or money order, the Agency shall <br /> deposit such payments into the Agency's Settlement Account for allocation <br /> under this Agreement. The transacting Agency shall bear the risk of fraud, <br /> dishonored checks for insufficient funds. <br /> 9.4.1.5 Website and Mobile Application Transactions. Transactions for the purchase <br /> of products on the ORCA Website or Mobile Application, including Autoload <br /> transactions, using credit or debit cards will be processed through the ORCA <br /> Central Payment Gateway. <br /> 9.4.2 Sales channels processed outside of the ORCA Central Payment Gateway include: <br /> 9.4.2.1 Washington State Ferries. WSF shall act as the merchant of record for all <br /> transactions processed at WSF terminals. Credit or debit card fees charged to <br /> WSF for over-the-counter transactions are the responsibility of WSF. In <br /> addition, WSF shall bear the risk of fraud, including chargebacks, unless WSF <br /> transfers the risk to its merchant bank. <br /> 27 <br />
