• <br /> • <br /> ORDINANCE NO. /6 / - 7 / <br /> AN ORDINANCE of the City of Everett, Washington <br /> providing for the acquisition of certain property <br /> for development of a neighborhood park, providing <br /> for the authorization of the City Attorney to initiate <br /> proceedings for condemnation, appropriation, taking <br /> and damaging of land and other property necessary <br /> therefor; declaring the necessity therefor; and providing <br /> for payment thereof; and that this ordinance shall become <br /> effective upon becoming valid. <br /> WHEREAS, in connection with the acquisition of certain property at the <br /> southwest corner of Beverly Lane and Madison Street for arterial street improve- <br /> ment purposes, the City Council of the City of Everett finds that adjacent property <br /> should be developed into a neighborhood park for the benefit of the general public, and <br /> WHEREAS, the City of Everett, in direct dealings with certain land owners, <br /> has been unable to acquire the portion of land necessary to the completion of the <br /> above improvement because of a valuation dispute, and <br /> WHEREAS, the City of Everett must now begin condemnation proceedings both to <br /> acquire the property and to settle the valuation question. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The public safety, necessity, and convenience demand, and the <br /> City Council so finds that the property hereafter described be improved by <br /> development of a neighborhood park including public conveniences and facilities <br /> as deemed appropriate by City Council: <br /> The North 71. 07 feet of the East 110 feet of Lot 1, Beverly <br /> Acreage Tracts, according to plat thereof recorded in volume <br /> 10 of plats, page 50, records of Snohomish County, Washington <br /> EXCEPT the North 30 feet thereof conveyed for roads, <br /> EXCEPT the following described tract: <br /> Beginning at the Southerly right-of-way of Madison Street and <br /> Westerly line of East 110. 0 feet of said Lot 1; thence Southerly <br /> along the Westerly line of said East 110. 0 feet of Lot 1 a distance <br /> of 6. 0 feet; thence Easterly parallel with the North line of said <br /> Lot 1 a distance of 79. 77 feet; thence on a curve to the right having <br /> a radius of 20. 0 feet and a central angle of 90°40'02" an arc distance <br /> of 21. 92 feet; thence Southerly parallel with the Easterly line of said <br /> Lot 1 to the Southerly line of the Northerly 71. 07 feet; thence Easterly <br /> along the Southerly line of the Northerly 71. 07 feet of said Lot 1 <br /> a distance of 10. 0 feet to the Easterly line of said Lot 1; thence <br /> Northerly along the Easterly line of said Lot 1 a distance of 41. 07 <br /> feet to the Southerly right-of-way line of Madison Street; thence <br /> Westerly along the Southerly right-of-way line of Madison Street <br /> to the point of beginning. <br /> That'the said property shall be acquired in fee for the purpose of the said improvement. <br /> Section 2: All land rights and privileges sought within the limits of the <br /> ' above described property are hereby condemned, appropriated, taken, and damaged <br /> .for public use and necessity for park purposes; and all such lands, rights and <br /> privileges are to be taken, damaged and appropriated only after just compensation <br /> has been made or paid in the court for the owners thereof in the manner provided <br /> by law. <br />
