ORDINANCE NO. t 44 ,a/ 7 / <br /> AN ORDINANCE providing for the vacation of all that portion <br /> of 14th Street lying 406 feet West of the West line of <br /> Norton Avenue . <br /> WHEREAS, the owners of more than two-thirds of the private <br /> property abutting upon the street above described have duly filed a petition <br /> with the City Council of the City of Everett praying for vacation of 14th Street <br /> (14th Street Dock); and <br /> WHEREAS, said City Council of the City of Everett did fix the <br /> 19th day of May, 1971, at 10:00 a. m. of said day for the hearing and determination <br /> of said petition; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> on said petition has been given by the City Clerk in the manner prescribed by law; <br /> and <br /> WHEREAS, at the time and place fixed for hearings and at <br /> subsequent times to which the hearing was continued, evidence regarding the <br /> vacating of the herein described Street was heard and discussed by the City <br /> Council; and <br /> WHEREAS, it now appears to the City Council of the City of Everett <br /> that said Street to be vacated should be vacated, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That a street of the City of Everett, County of Snohomish, <br /> State of Washington, described as follows, to-wit: <br /> A portion of 14th Street lying West of Norton Avenue <br /> described as follows: <br /> Begin at the Northwest corner of Block 343, Plat of <br /> Everett, Division L; thence North along the East side <br /> of Grand Avenue for 1027 feet to a point 13 feet south <br /> of the North line of 14th Street; thence angle left <br /> 90°00' to a point 130 feet West of the West line of <br /> the right of way of the Seattle-Montana Railroad Company <br /> and the True Point of Beginning; thence continue West <br /> on the same straight line 406. 00 feet; thence angle <br /> left 90°00' for 16 feet; thence angle left 90°00' <br /> for 406. 00 feet; thence angle left 90°00' for 16 feet <br /> to the True Point of Beginning, <br /> be and the same is hereby vacated, SUBJECT to the following conditions, <br /> restrictions and reservations: <br /> That the City of Everett retains an easement to construct, <br /> operate, maintain, repair and replace all public utilities <br /> under, over, and across the following described portion <br /> of the vacated property to enter said property at any and <br /> all times for said construction operation, maintenance, <br /> repairs and replacement.
