i
BOARD OF ADJUSTMENT
I FINDINGS, CONCLUSIONS AND ORDER VARIANCE NO. 51-87
Based upon the written request for a variance from the City's zoning coda by:
i
,I MGR Partnership
17215 Smokey Point Dr.
Arlington, NA 98203
hereinafter referred to as "Applicant," for variance from E.M.C.19.24.020 (F)
Signs, to allow:
A 76 square foot pole sign instead of the 30 square feet allowed by
code on the property described in Attachment A,
commonly known as: 9505 19th Ave. S.E.
The 4oard of Adjustment, following a public hearing on said application held
on January 4, 1988, and further having reviewed all testimony, makes the
following Findings, Conclusions and Order:
VARIANCE CRITERIA:
Findings and Conclusions:
Criterion •1: That there have been exceptional or extraordinary circum
stances or conditions applying to the subject property or as to the intended
use thereof that do not apply generally to other properties in the same
vicinity or zone.
a. Finding 11: The project site is zoned B-1, Neighborhood
Business and the improvements consists of an approximately 20,000
square foot office building on a 2.3 acre site.
The B-1 zone allows one lighted or unlighted free standing or pole Sinn
30 square feet i•i area serving a multi -tenanted building on a single
lot. In addition, each separate business establishment is allowed one
wall sign or for projecting sign limited to one square foot of signage
for each linear foot of the front wall of each business es.ablishment,
not to exceed 30 square feet in area.
This site is located on a busy arterial street and the properties
directly across the street are zoned B-2, Community Business, which has
no limit on the size or number of signs. Many B-1 zones are located on
residential streets and are surrounded by residentially zoned property,
which is the reason for the signing restrictions in the B-1 zone.
In addition, the new Comprehensive Plan adopted in 1987 designates this
area as Highway Commercial. The former designation wan Business/Light
Commercial.
The applicant does not wish to place separate signs on the front of the
building itself for each business establishment as the code allows,
since the face of the building is stucco an6 it would spoil the
aesthet.cs of the building. In addition, the building is set back
approximately 160 feet from the street and so the signs on the face of
the building would not be effective.
Therefore, the applicant wishes to add a six foot by eight foot section
to an existing pole sign abutting the 19th Ave. S.E. right of wav ana
list the names of the business establishments on that sign.
b. Conclusion M1: There are exceptional circumstances applying to
the subject property that do not apply generally to other property In
the vicinity.
Criterion t2: That such variance is necessa+:y or the preservation and en
lcyment of a substantial property right of the appellant pos sessed by the•
owners of other properties in the same vicinity or zone.
a. Finding: Since the property is located directly across the street
from an area zoned B-2, where :hers= is no limit on height or size 01
