The Board has granted variances in the past to <br />applicants whose property was ocated in a B-1 zone which was directly <br />across the street from a B-2 2 ne. <br />b. Conclusion M2: Granting this variance would allow the —applicant a <br />property right possessed by others in the vicinity. <br />Criterion t3: That the authorization of such variance will not be materi <br />ally detrimental to the public welfare or injurious to prop erty in the <br />vicinity or zone in which the property is to cated. <br />a. Finding i3: There have been no adverse comments <br />received in response to notices sent to property owners in the area and <br />there were no adverse comments from the Public Works Department. <br />b. Conclusion 43: It does not appear that there would be any adverse <br />affect on other property owners i.i the vicinity and zone if this <br />variance is granted. <br />Criterion i4: That the granting of such variance will not adversely affect <br />the Comprehensive General Plan. <br />a. Finding N4: The Comprehensive Plan designation for <br />this property is Highway Commercial and the property across the street <br />which is currently zoned B-2 is also designated Highway Commercial and <br />so it would be reasonable to have the same sign requirements on both <br />sides of the street. <br />b. Conclusion N4: Granting this variance would not <br />adversely affect the comprehensive plan. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett does hereby or- <br />der that the variance be GRANTED to allow a 76 square foot pole sign instead of <br />the 30 square feet allowed by code and further require the applicant to meet <br />the following conditions. <br />1. Obtain a sign permit and comply with all requirements of the sign <br />code. - <br />2. The free standing sign adjacent to the driveway on the south, the <br />portable reader board, sandwich board and other miscellaneous signs <br />shall be removed. <br />3. Wall or projecting signs shall not be permitted on the front walls <br />of each separate business establishment singce this variance for a <br />larger pole sign has been granted in lieu of the separatea wall sign <br />for each business. <br />The action of the Board of Adjustment in GRANTING a variance shall be final <br />and conclusive, unless within fifteen (15) days from the date of issuance and <br />signing of this order by the Chairman of the Board, an aggrieved person or per- <br />sons obtains a writ of certiorari from the Superior Court of Washington for <br />Snohomish County for the purpose of review of t::e action taken. <br />DATED thisday if 1987. <br />Chairman, Board of Adjustment <br />Notes to Applicant: <br />1. If a building permit is not obtained within one Year from the above <br />date, the Board's decision shall cease to be effective. Prior to the expira- <br />tion date, a written request for a six-month extension may be submitted to <br />the Planning Director. <br />2. A copy of this order must be submitted by the Applicant when applying <br />for building permits. <br />
