4;--e-, /les -7/ <br /> • <br /> • <br /> • . <br /> 1 • <br /> • r <br /> ORDINANCE NO. / % / <br /> AN ORDINANCE providing for the vacation of Rockefeller <br /> between Wall and Pacific and the alley running east <br /> and west between Oakes and Rockefeller. <br /> WHEREAS, the owners of more than two-thirds of the property abutting <br /> upon the street above described have duly filed a petition with the City Council <br /> of the City of Everett praying for vacation of Rockefeller between Wall and <br /> Pacific and the alley running east and west between Oakes and Rockefeller, <br /> and <br /> WHEREAS, said City Council of the City of Everett did fix the 14th day of <br /> October, 1970, at 10:00 a. m. of said day for the hearing and determination <br /> of said petition; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> the determination of said petition has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, objections to the <br /> vacating of the herein described street were heard and discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that <br /> a portion of said street to be vacated should be vacated, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the streets of the City of Everett, County of Snohomish, <br /> State of Washington, described as follows, to-wit: <br /> Rockefeller from the south property line of Wall <br /> Street to the north property line of Pacific and the <br /> alley running east and west between Oakes and Rockefeller <br /> be and the same is hereby vacated, SUBJECT to the following conditions, restrictions <br /> and reservations: <br /> That the City of Everett retains a pedestrian thoroughfare <br /> parkway and open space easement over and across the vacated <br /> area of Rockefeller between Wall and Pacific, and which shall <br /> be developed and maintained by Snohomish County, and the <br /> City of Everett further retains an easement to construct, <br /> operate, maintain, repair and replace all public utilities <br /> under, over and across all of said vacated property.
