• <br /> ' Permit Section of the Engineering Department shall certify <br /> 'the facts justifying such a 'refund•, the amount thereof and ' <br /> approval of such refund, and upon presentation of such certificate <br /> to the City Clerk, such officer is authorized to draw and the <br /> City Treasurer to pay a warrant on the General Fund in the <br /> amount of such refund, and the necessary appropriations are <br /> hereby made from any surplus in the fund. <br /> Section 162 . 46 .44 . 230 Permit Issue - Bond. Upon approval of <br /> the application by the City Traffic Engineer and upon receipt of <br /> the prescribed fee , trucking and parking permits shall be <br /> issued by the Traffic Engineer, embodying the conditions above <br /> set forth , provided, that the applicant may, as a condition to <br /> the issuance of the permit, be required by the Traffic Engineer <br /> to execute and deliver to the City a good and sufficient surety <br /> bond, or deposit in cash in lieu thereof, in the sum of not less <br /> than two hundred dollars , conditioned to save the City harmless <br /> from all injuries caused by the use of any street under such <br /> permit, or by act of omission of the permitee thereunder; <br /> Provided further that the issuance of such permit shall not be <br /> construed as a waiver of the City 's right to recover for any <br /> injuries to the streets or other property of the City resulting <br /> from the transportation or other operation pursuant thereto . <br /> Section 163 . 46 . 44 . 240 Operation in Central Business District - <br /> General. No person shall operate a motor vehicle with trailer <br /> attached or a motor truck and semi-trailer exceeding an overall <br /> length of thirty feet in the Central Business District between <br /> eleven o 'clock a.m. and seven o 'clock p.m. without obtaining <br /> a permit for such operation as provided in Sections 46 .44 .160 and <br /> 46 . 44 .190 . <br /> Section 164 . 46 .44 .250 Operation in Central Business District <br /> Peak Hour. No person shall operate a vehicle , except authorized <br /> buses or stages , over eight feet in width, over twenty-four feet <br /> in length, or over twenty-four thousand pounds gross weight in <br /> the Central Business District between the hours of four o 'clock <br /> p.m. and six o 'clock p.m. without obtaining a permit for such <br /> operation as provided in Sections 46 . 44 . 160 and 46 . 44 . 190 . <br /> Section 165 . 46 .44 . 260 Central Business District Defined. For <br /> the purpose of this Ordinance the streets forming the boundaries <br /> of the Central Business District as defined in Section 46 .04 .113 <br /> shall be considered as lying outside of said Central Business <br /> District . <br /> Section 166 . 46 .44 .270 Operations on non-arterial residential <br /> streets . No person shall operate a motor vehicle, except <br /> authorized buses , disposal trucks , utility and city owned main- <br /> tenance trucks , over eight thousand pounds gross weight on any <br /> non-arterial residential street within the City of Everett: Provided, <br /> that motor vehicles in excess of eight thousand pounds gross weight <br /> and less than the legal maximum gross weight may be operated on <br /> such a non-arterial residential street; (1) For the purpose of <br /> making deliveries to or from property with access restricted <br /> to such a non-arterial residential street; (2) when a business <br /> is located on such a non-arterial residential street and the <br /> normal trucking activity for such a business must use such a <br /> non-arterial residential street to gain access to such a business ; <br /> Provided further, that a permit may be obtained from the City <br /> Traffic Engineer as provided in Sections 46 .44 .160 and 46 .44 .190 <br /> to operate a motor vehicle contrary to the provisions of this <br /> Section. <br /> Chapter 46 . 52 <br /> Accidents-Reports-Abandoned Vehicles <br /> Section 170 .
