• ' Permit Section of the Engineering Department shall certify 'the facts justifying such a 'refund•, the amount thereof and ' approval of such refund, and upon presentation of such certificate to the City Clerk, such officer is authorized to draw and the City Treasurer to pay a warrant on the General Fund in the amount of such refund, and the necessary appropriations are hereby made from any surplus in the fund. Section 162 . 46 .44 . 230 Permit Issue - Bond. Upon approval of the application by the City Traffic Engineer and upon receipt of the prescribed fee , trucking and parking permits shall be issued by the Traffic Engineer, embodying the conditions above set forth , provided, that the applicant may, as a condition to the issuance of the permit, be required by the Traffic Engineer to execute and deliver to the City a good and sufficient surety bond, or deposit in cash in lieu thereof, in the sum of not less than two hundred dollars , conditioned to save the City harmless from all injuries caused by the use of any street under such permit, or by act of omission of the permitee thereunder; Provided further that the issuance of such permit shall not be construed as a waiver of the City 's right to recover for any injuries to the streets or other property of the City resulting from the transportation or other operation pursuant thereto . Section 163 . 46 . 44 . 240 Operation in Central Business District - General. No person shall operate a motor vehicle with trailer attached or a motor truck and semi-trailer exceeding an overall length of thirty feet in the Central Business District between eleven o 'clock a.m. and seven o 'clock p.m. without obtaining a permit for such operation as provided in Sections 46 .44 .160 and 46 . 44 .190 . Section 164 . 46 .44 .250 Operation in Central Business District Peak Hour. No person shall operate a vehicle , except authorized buses or stages , over eight feet in width, over twenty-four feet in length, or over twenty-four thousand pounds gross weight in the Central Business District between the hours of four o 'clock p.m. and six o 'clock p.m. without obtaining a permit for such operation as provided in Sections 46 . 44 . 160 and 46 . 44 . 190 . Section 165 . 46 .44 . 260 Central Business District Defined. For the purpose of this Ordinance the streets forming the boundaries of the Central Business District as defined in Section 46 .04 .113 shall be considered as lying outside of said Central Business District . Section 166 . 46 .44 .270 Operations on non-arterial residential streets . No person shall operate a motor vehicle, except authorized buses , disposal trucks , utility and city owned main- tenance trucks , over eight thousand pounds gross weight on any non-arterial residential street within the City of Everett: Provided, that motor vehicles in excess of eight thousand pounds gross weight and less than the legal maximum gross weight may be operated on such a non-arterial residential street; (1) For the purpose of making deliveries to or from property with access restricted to such a non-arterial residential street; (2) when a business is located on such a non-arterial residential street and the normal trucking activity for such a business must use such a non-arterial residential street to gain access to such a business ; Provided further, that a permit may be obtained from the City Traffic Engineer as provided in Sections 46 .44 .160 and 46 .44 .190 to operate a motor vehicle contrary to the provisions of this Section.
