RCW 46 . 52 . 040 ---Report when operator disabled. <br /> RCW 46. 52 . 070 Police Officer' s report <br /> ' RCW 46 . 52. 080 Confidentiality of :reports--Information <br /> required to be disclosed--Evidence . <br /> RCW 46 . 52. 090 Reports by repairmen, storagemen, and <br /> appraisers - Violations , Penalties . <br /> RCW 46 . 52. 100 Record of traffic charges - Reports of <br /> convictions by courts--Venue in justice <br /> courts--Driving under influence of liquor <br /> or drugs , penalty. <br /> Section 171 46. 52. 101 Abandoned, wrecked, dismantled or <br /> inoperative vehicles declared a public nuisance. Abandoned <br /> wrecked, dismantled or inoperative vehicles or automobile <br /> hulks or parts thereof on public or private property, except as <br /> provided for elsewhere in Sections 46 . 52 . 101 through 46 . 52 . 132 <br /> are hereby declared a public nuisance and may be abated. It <br /> shall be unlawful for any person, firm, or corporation to <br /> place or keep an abandoned vehicle, abandoned automobile hulk, <br /> wrecked, dismantled, or inoperative vehicle, or parts thereof, <br /> upon any public or private property in the City of Everett; or <br /> as owner, occupier, or party in control of any real property <br /> within the city, to permit or allow any such automobile or <br /> portion thereof to be placed or kept on said property. Any <br /> person violating Section 46. 52 . 101 through 46 . 52 . 132 shall be <br /> guilty of maintaining a nuisance. <br /> Section 172 46. 52. 103 Evidence of junked vehicle. It shall <br /> be prima facie evidence that any vehicle on private or public <br /> property is junked and/or inoperative if the same is (a) <br /> inoperative by reason of damage, neglect or the removal of parts <br /> therefrom, (b) is unlicensed for current operation on a public <br /> street, and (c) has been substantially in the same condition <br /> for more than ten days . <br /> Section 173. Statutes adopted. The following statutes are <br /> hereby adopted by reference. <br /> RCW 46. 52 . 104 Registered owner transferring vehicle <br /> relieved of liability upon compliance with <br /> section. <br /> RCW 46. 52. 106 Owner of record presumed liable for costs <br /> when vehicle abandoned--Exception. <br /> Section 174. 46. 52. 107 Police Department authorized to remove <br /> or impound vehicles . The Police Department is hereby authorized to <br /> remove and impound vehicles from any public street, alley or <br /> other public place, or from private property in any of the <br /> following circumstances : <br /> (a) Any vehicle parked in such a position that it constitutes <br /> an obstruction to traffic or is unlawfully parked in any prohibited <br /> or restricted area, or is parked or so used as to endanger or <br /> likely endanger any user or potential user of any public highway, <br /> or used in violation of the traffic ordiances of the City of <br /> Everett or of any rule or regulation promulgated in connection <br /> therewith by the Chief of Police acting in conjunction with <br /> the City Council, is hereby declared to be a nuisance. Such <br /> nuisance may be summarily abated by removing the vehicle by <br /> or under the direction of a police officer by means of towing <br /> or otherwise. <br /> (b) In the event that an operator of a vehicle is arrested <br /> and placed in custody and is not in condition to drive the <br /> vehicle to a place of safety and there is no other person present <br /> who may properly act as agent for such operator to drive the <br /> vehicle to a place of safety, or the operator of a vehicle <br /> is incapacitated as the result of an accident and is <br /> unable to care for his property, and there is no other person <br /> present who may properly act as agent for such operator in the <br /> care of his vehicle, any officer at the scene of such arrest or <br /> accident is hereby authorized to provide for the removal of <br /> such vehicle to a place of safety. <br /> Cc) When any "abandoned vehicle" or "abandoned automobile <br /> hulk" as defined in Sections 46 . 04 . 013 and 46 . 04 . 017 is found <br /> on public or private property. <br /> -21- <br />
