' ,and storage charges on each yeIiicl . impounded shall be paid by the owner or his agent if said vehicle be redeemed. In the case of abandoned vehicles, all costs of removal and storage shall be received from the proceeds of sale. The impounding of a vehicle shall not prevent or preclude the institution and prosecuting of criminal proceedings in the Police Court, or elsewhere, charging the violator with any violation of the law on account of which such vehicle was impounded. Section 175. 46 . 52. 109 Appointment of tow truck operator to dispose of vehicles and hulks - Bond - Compliance required. The Chief of Police may appoint any towing truck operator engaged in removing and storing of abandoned motor vehicles as his agent for the purpose of disposing of certain abandoned vehicles and automobile hulks. Each such appointment shall be contingent upon the submission of an application to the Chief of Police and the making of subsequent reports in such form and frequency as may be required by rule and regulation and upon the posting of a surety bond in the amount of $3 , 000 . 00 with the City Clerk of the City of Everett to ensure compliance with RCW 46 . 52 . 111 and 46. 52 . 119 and to compensate the owner of any vehicle that has been unlawfully sold as a result of any negligence or misconduct of the tow truck operator . Any appointment may be cancelled by the Chief of Police upon evidence that the appointed tow truck operator is not complying with all laws , rules and regulations relative to the handling and disposition of abandoned motor vehicles . Section 176. Statutes adopted. The following statutes are hereby adopted by reference. RCW 46. 52. 110 Stolen and abandoned vehicles --Reports of-- Notice--Disposition. RCW 46 . 52. 113 Vehicle left in garage for storage-- when deemed abandoned--Notices--Disposal. RCW 46 . 52. 114 Tow truck operator' s lien--Unclaimed vehicle deemed abandoned. RCW 46 . 52. 119 Person owning or in possession of real property may have abandoned vehicle removed and impounded--Report--Line. Section 177 . 46. 52. 121 Disposition of abandoned vehicles--when vehicles deemed abandoned--Procedure. Any vehicle impounded pursuant to this Code and left unclaimed for a period of fifteen days shall be deemed to be an abandoned vehicle, and at the expiration of such period said vehicle shall be deemed to be in the custody of the sheriff of Snohomish County, and said sheriff of the county shall deliver the vehicle to a tow truck operator who shall dispose of such vehicle in the manner provided in RCW 46. 52. 111 and 46. 52 . 112 ; provided, that if the vehicle is of a model year ten or more years prior to the calendar year in which such vehicle is stored, the sheriff of Snohomish County is authorized to declare that such vehicle is a public nuisance, and may dispose of such vehicle without notice of sale, and in such case the director of motor vehicles shall issue an appropriate bill of sale to the tow truck operator to dispose of the vehicle as he may determine. Section 178 . 46. 52. 123 Investigation of nuisance--Hearings-- Abatement procedures. The Chief of Police and the City Building Official shall have concurrent responsibility to inspect and investigate complaints relative to wrecked, dismantled, or inoperative vehicles or automobile hulks , or parts thereof, on private property. Upon discovery of such nuisance, the Police Department or Inspection Department shall give notice in writing to the last registered owner of record of the vehicle -22-
