• <br /> . All costs frncurred by the City in the removal and storage. of an <br /> iMpounded vehicle shall be a lien upon the. vehicle. All towing ; . ' <br /> ,and storage charges on each yeIiicl . impounded shall be paid <br /> by the owner or his agent if said vehicle be redeemed. In the <br /> case of abandoned vehicles, all costs of removal and storage <br /> shall be received from the proceeds of sale. The impounding <br /> of a vehicle shall not prevent or preclude the institution <br /> and prosecuting of criminal proceedings in the Police Court, or <br /> elsewhere, charging the violator with any violation of the law on <br /> account of which such vehicle was impounded. <br /> Section 175. 46 . 52. 109 Appointment of tow truck operator to <br /> dispose of vehicles and hulks - Bond - Compliance required. <br /> The Chief of Police may appoint any towing truck operator <br /> engaged in removing and storing of abandoned motor vehicles <br /> as his agent for the purpose of disposing of certain abandoned <br /> vehicles and automobile hulks. Each such appointment shall be <br /> contingent upon the submission of an application to the Chief <br /> of Police and the making of subsequent reports in such form <br /> and frequency as may be required by rule and regulation and upon <br /> the posting of a surety bond in the amount of $3 , 000 . 00 with <br /> the City Clerk of the City of Everett to ensure compliance with <br /> RCW 46 . 52 . 111 and 46. 52 . 119 and to compensate the owner of any <br /> vehicle that has been unlawfully sold as a result of any <br /> negligence or misconduct of the tow truck operator . <br /> Any appointment may be cancelled by the Chief of Police upon <br /> evidence that the appointed tow truck operator is not complying <br /> with all laws , rules and regulations relative to the handling <br /> and disposition of abandoned motor vehicles . <br /> Section 176. Statutes adopted. The following statutes are <br /> hereby adopted by reference. <br /> RCW 46. 52. 110 Stolen and abandoned vehicles --Reports of-- <br /> Notice--Disposition. <br /> RCW 46 . 52. 111 Removal and storage of vehicle or hulk-- <br /> lien--Notices--Contents . <br /> RCW 46 . 52. 112 Sale of unclaimed vehicle or hulk--Pro- <br /> cedure--Proceeds--Deficiency. <br /> RCW 46 . 52. 113 Vehicle left in garage for storage-- <br /> when deemed abandoned--Notices--Disposal. <br /> RCW 46 . 52. 114 Tow truck operator' s lien--Unclaimed <br /> vehicle deemed abandoned. <br /> RCW 46 . 52. 119 Person owning or in possession of real <br /> property may have abandoned vehicle <br /> removed and impounded--Report--Line. <br /> Section 177 . 46. 52. 121 Disposition of abandoned vehicles--when <br /> vehicles deemed abandoned--Procedure. Any vehicle impounded <br /> pursuant to this Code and left unclaimed for a period of fifteen <br /> days shall be deemed to be an abandoned vehicle, and at the <br /> expiration of such period said vehicle shall be deemed to be in <br /> the custody of the sheriff of Snohomish County, and said sheriff <br /> of the county shall deliver the vehicle to a tow truck operator <br /> who shall dispose of such vehicle in the manner provided in <br /> RCW 46. 52. 111 and 46. 52 . 112 ; provided, that if the vehicle is <br /> of a model year ten or more years prior to the calendar year in <br /> which such vehicle is stored, the sheriff of Snohomish County <br /> is authorized to declare that such vehicle is a public nuisance, <br /> and may dispose of such vehicle without notice of sale, and in <br /> such case the director of motor vehicles shall issue an appropriate <br /> bill of sale to the tow truck operator to dispose of the vehicle as <br /> he may determine. <br /> Section 178 . 46. 52. 123 Investigation of nuisance--Hearings-- <br /> Abatement procedures. The Chief of Police and the City Building <br /> Official shall have concurrent responsibility to inspect and <br /> investigate complaints relative to wrecked, dismantled, or <br /> inoperative vehicles or automobile hulks , or parts thereof, <br /> on private property. Upon discovery of such nuisance, the <br /> Police Department or Inspection Department shall give notice in <br /> writing to the last registered owner of record of the vehicle <br /> -22- <br />
