The <br /> notice shall indicate the unlawful use of the parking <br /> • space . It shall constitute a violation of this chapter to <br /> use a hood after notice of revocation is given permittee . <br /> G . Any such permit issued hereunder shall , unless revoked, be <br /> valid for a period of one year from the first of January or <br /> any portion of the year from the date of issuance to the <br /> following December thirty-first. <br /> H. The fee for a permit shall be one hundred dollars ($100 .00 <br /> per year or ten dollars ($10 .00) for each month or portion <br /> thereof for periods less than such year. The permittee shall <br /> also pay at the time of issuance of the hood a five dollar <br /> ($5 .00) deposit for the use of the hood, which shall remain <br /> the property of the City of Everett. In case hoods become <br /> lost or destroyed or so defaced that they are no longer <br /> usable , the permittee shall pay the City five dollars ($5 .00) <br /> for issuance of a new hood. Upon return of the hood in good <br /> condition the five dollar deposit shall be returned. <br /> Section 300 . 46 .61 .965 Removal of meters to facilitate construction. <br /> No parking meters shall be removed for the purpose of facilitating <br /> construction on private property except by the City of Everett, <br /> and then only after permit has been obtained for its removal by the <br /> applicant. Any person desiring a parking meter to be removed during <br /> a period of construction shall make application to the Finance and <br /> Budget Director, which application shall be accompanied by a fee <br /> of ten dollars ($10 .00) for each meter to be removed. The Finance <br /> and Budget Director shall refer the matter to the Engineering <br /> Department who shall approve or disapprove its removal . If approved, <br /> a permit shall be granted and the parking meter shall be removed for <br /> such time as the Engineering Department shall deem reasonable and <br /> necessary . Thereafter, the parking meter shall be reinstalled by <br /> the City of Everett. This section shall supersede all ordinances <br /> or parts of ordinances in conflict herewith. <br /> Section 300 (a) 46 .61 . 970 Notice of Violation. The Notice of <br /> Violation shall be in a form that shall state the location and nature <br /> of the offense, the vehicle license number of the vehicle, the state <br /> of the license number, the vehicle make , the time and date of violation <br /> and the penalty for said violation. <br /> Section 300 (b) 46 .61 .975 Penalties for parking and parking meter <br /> violations . Except as expressly provided, penalties for overtime <br /> parking and parking meter violations shall be one dollar ($1 .00) when <br /> paid within 48 hours of the time of violation, or two dollars ($2 .00) <br /> if not paid within 48 hours . All other parking violations except as <br /> expressly provided shall be subject to a penalty of three dollars <br /> ($3 .00) . Any person who fails or refuses upon notice to pay said <br /> penalty shall be subject to civil suit brought in any court of the <br /> State of Washington to collect said penalties and shall be responsible <br /> in addition thereto for reasonable attorney 's fees and costs of court. <br /> Said penalty, attorney 's fees and costs shall be collectible by <br /> the same means as any other civil judgment. Any person who shall <br /> operate a motor vehicle on the streets of the City of Everett shall <br /> be deemed thereby to have consented to pay all court costs including <br /> a reasonable attorney 's fee for actions brought to collect penalties <br /> imposed by this chapter if he is found to have been in violation <br /> of said chapter. <br /> Section 300 (c) . 46 .61.980 Administrative Appeal of Parking Notices , <br /> Parking Hearing Offices . Any person, who upon receipt of a Notice of <br /> Violation feels he has been unjustly accused of violating a parking <br /> ordinance of the City of Everett, may state his disagreement and <br /> reasons therefor to the City Treasurer, or such other official as shall <br /> be designated by the Finance and Budget Director for the hearing <br /> of parking and parking meter appeals . If said official determines <br /> that the alleged violator was improperly accused the notice shall <br /> be dismissed. If the hearing officer determines that the notice <br /> was properly given and the alleged violator continues to disagree <br /> the City may proceed with court proceedings as hereinbefore provided. <br /> -49- <br />
