Any persorh. • <br /> . h4ging. been notified of a parking' of parking . meter violation in the - <br /> , „' manner hereinbefore provided who shall fail to pay said penalty <br /> within five (5) days or in the . alternative to appear before the <br /> administrative hearing officer to appeal the notice of violation of <br /> the parking ordinance within five (5) days shall be guilty of <br /> a misdemeanor and upon conviction thereof shall be punished by <br /> a fine in the amount of not more than one hundred dollars ($100 .00) . <br /> Section 300 (e) . 46 .61 .990 Registered Owner Responsible. Every <br /> person in whose name a vehicle is registered (licensed) shall be <br /> prima facie responsible for any parking of such vehicle and for <br /> all offenses other than moving violations in violation of this <br /> title . It shall be a defense to such charges that such vehicle <br /> was illegally parked by another, without the consent of the <br /> registered (licensed) owner thereof. In case of a leased car, <br /> the lessee shall be prima facie responsible in the same manner <br /> as a registered owner of a vehicle under this section. It shall <br /> be unlawful for the registered owner of a leased vehicle to fail <br /> to disclose on request by an officer of the City of Everett the <br /> name and address of said lessee . Failure to give such information <br /> shall be a misdemeanor punishable by a fine of not more than $250 .00 . <br /> CHAPTER 46 .62 <br /> RAILROAD REGULATIONS <br /> Section 301 A. 46 .62.010 Trains obstructing traffic--Ten Minute <br /> Limit. It shall be unlawful to cause or permit any railroad car or <br /> locomotive to remain at the crossing of any street, avenue , highway <br /> or public route of travel in the City of Everett so as to obstruct <br /> traffic or travel on said street, avenue , highway or public route <br /> of travel for any longer period then ten (10) consecutive minutes <br /> at any one time. <br /> Section 301 B. 46 .62 .020 Violations--Penalty . Any conductor, <br /> engineer, or brakeman in charge of any railroad car, locomotive <br /> or train of cars , or any person, who shall do, cause or permit <br /> any act to be done in violation of the provisions of Section 46 .62 .010 <br /> shall on conviction be punished by a fine not exceeding one hundred <br /> dollars ($100 .00) , or by imprisonment not exceeding thirty (30) <br /> days , or both such fine and imprisonment . <br /> Section 301 C . 46 .62 .030 Speed limit--Prescribed. Except where <br /> an underpass or overpass exists it shall be unlawful to operate <br /> any locomotive or train over, along or across any street, avenue <br /> or alley within the corporate limits of the City of Everett at <br /> a greater speed than hereinafter prescribed. <br /> A. That area of the city lying west of Broadway Avenue, <br /> thirty-five (35) miles per hour, except at Bond Street, <br /> Hewitt Avenue, Everett Avenue and California Avenue <br /> where the speed shall not be greater than twenty-five <br /> (25) miles per hour. <br /> B. That area of the city lying east of Broadway Avenue , <br /> forty-five (45) miles per hour, except at Pacific <br /> Avenue, Hewitt Avenue, Everett Avenue and California <br /> Avenue where the speed shall not be greater than <br /> thirty (30) miles per hour. <br /> Section 301 D. 46 .62. 040 Violations--Penalty. Every person or <br /> corporation (including officer or employees thereof) who shall <br /> violate the provisions of Section 46 .62 .030 , shall be deemed <br /> guilty of a misdemeanor and upon conviction thereof shall be <br /> adjudged to pay a fine of not less than ten dollars ($10 .00) <br /> nor more than one hundred dollars ($100 .00) , and the costs of <br /> prosecution, or in default of the payment of said fine and <br /> costs , be imprisoned for a period of time not exceeding one day <br /> for each three dollars ($3.00) of said fine and costs . <br /> -50- <br />
