w <br /> • . • i • <br /> • <br /> • <br /> ,'t ,Section 301 E. 46. 62. 050 Railway gates required on Hewitt Avenue. <br /> Any person, firm or corporation operating any railway engines or <br /> cars on railway tracks laid on or across Hewitt Avenue, between <br /> Federal Street and the shore of Puget Sound, in the City of <br /> Everett, is hereby required to install and maintain railway <br /> gates on both sides of the such tracks extending across said <br /> Hewitt Avenue, which gates shall at all times be in charge of <br /> and operated by a competent person and shall be closed whenever any <br /> cars or engines shall have crossed said Hewitt Avenue. Provided, <br /> however, that this section shall apply only to railway tracks <br /> crossing said Hewitt Avenue at grade between the points herein- <br /> before specified. <br /> Section 301 F. 46 . 62. 060 Violations--Penalty. Every railroad <br /> company or corporation and every officer or agent of any railroad <br /> company or corporation who shall neglect or refuse to establish <br /> or maintain gates as required by Section 46 . 62 . 050 of this <br /> chapter, shall, upon conviction, be punished by a fine of not <br /> less than twenty dollars ($20 . 00) nor more than one hundred dollars <br /> ($100 . 00) , and every day after the expiration of said period of <br /> ninety (90) days from the taking effect of this chapter that <br /> any such crossing shall remain without gates shall be deemed a <br /> distinct offense and punishable accordingly. <br /> CHAPTER 46. 64 <br /> ENFORCEMENT <br /> Section 302 Statutes adopted. The following statutes are hereby <br /> adopted by reference. <br /> RCW 46 . 64. 010 Traffic citations--Record of--Cancellation <br /> prohibited--Penalty--Citation audit. <br /> RCW 46. 64. 015 Citation and notice to appear in court-- <br /> Issuance--Contents--Written promise-- <br /> Arrest. <br /> RCW 46. 64. 020 Nonappearance after written promise, mis- <br /> demeanor. <br /> RCW 46. 64. 025 Nonappearance after written promise-- <br /> Notice to department. <br /> RCW 46. 64. 030 Procedure governing arrest and prosecution. <br /> RCW 46 . 64. 048 Attempting, aiding, abetting, coercing, committing <br /> violations, punishable. <br /> Section 303 46. 64. 050 General Penalty. Any person who shall violate <br /> or fail to comply with any of the provisions of this title, or who <br /> shall counsel, aid, or abet any such violations or failure to comply, <br /> except parking and parking meter violations, shall be deemed guilty <br /> of a misdemeanor, and upon conviction thereof, where no other penalty <br /> or punishment is provided herein, shall be punished by a fine in any <br /> sum not exceeding five hundred dollars ($500 .00) , or by imprisonment <br /> in the County Jail for a term not exceeding six (6) months , or both <br /> such fine and imprisonment. <br /> Section 304 . 46. 64. 060 When warrant to be issued. <br /> A. Residents . The court shall issue a warrant for the arrest <br /> of any defendant who is a resident of this state and who <br /> has failed to appear before the court or the traffic violations <br /> bureau either in person or by counsel in answer to a traffic <br /> complaint and citation upon which he has given his written <br /> promise to appear. If the warrant is not executed within 30 <br /> days after issue, the court shall make an entry of the <br /> notification on the docket, and may add a charge against the <br /> defendant for failure to appear after a written promise <br /> to do so and mark the case closed subject to being reopened <br /> when the appearance of the defendant is thereafter obtained. <br /> -51- <br />
