• ORDINANCE NO. in LI-70 AN ORDINANCE establishing an application fee for application under the Open Space Taxation Act of the State of Washington, Chapter 87, Laws of 1970, Extraordinary Session WHEREAS, the Legislature of the State of Washington has enacted an Open Space Taxation Act, Chapter 87, Laws of 1970, Extraordinary Session, which provides for an application to be acted upon in a city with a comprehensive plan in the same manner in which an amendment to the comprehensive plan is processed by such city, and, WHEREAS, Section 3 of Chapter 87, Laws of 1970, Extraordinary Session, allows a municipal corporation to establish a reasonable processing fee which shall accompany an application for classification, and, WHEREAS, the City of Everett has adopted a comprehensive plan, and WHEREAS, a fee of Fifty Dollars ($50. 00), plus One Dollar ($1. 00) per acre or any part thereof and the actual cost incurred for publication of legal notices is considered a reasonable processing fee to reimburse the city for the administrative cost incurred in processing an application for classification: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The application fee for applications under the Open Space Taxation Act, Chapter 87, Laws of 1970, Extraordinary Session, shall be Fifty Dollars ($50. 00), plus One Dollar ($1. 00) per acre or any part thereof and the actual cost incurred for publication of legal notices as determined at the final hearing. The Snohomish County Assessor is hereby authorized to collect such fee, exclusive of publication costs, and to forward the application to the City Planning Department and the fee to the City Treasurer for deposit in the general fund of the City of Everett. The City Treasurer shall collect publication costs directly from the applicant. No agreement shall be executed until city administration fees and publication costs have been paid in full.
