• <br /> Section 3: <br /> The abandonment of any vehicle or automobile hulk shall <br /> constitute a prima facie presumption that the last owner of record is <br /> responsible for such abandonment and thus liable for any costs incurred <br /> in removing, storing and disposing of such motor vehicle or automobile <br /> hulk. A registered owner who has complied with the requirements of <br /> Section 39, Chapter 281, Laws of 1969, Ex. Session, shall be relieved <br /> of liability under this section. <br /> Section 4: <br /> It shall be the duty of the Chief of Police of the City of Everett <br /> to report immediately to the Chief of the Washington State Patrol all <br /> motor vehicles reported to them as stolen or recovered upon forms <br /> to be provided by the Chief of the Washington State Patrol. <br /> In the event that any motor vehicle reported as stolen has been <br /> recovered, the person so reporting the same as stolen shall be guilty <br /> of a misdemeanor unless he shall report the recovery thereof to the <br /> Chief of Police of the City of Everett. <br /> It shall be the duty of the Chief of Police of the City of Everett <br /> to report to the Chief of the Washington State Patrol all vehicles or <br /> automobile hulks found abandoned on a public highway or at any other place <br /> and the same shall thereafter and at the direction of such law enforcement <br /> officer be placed in the custody of a tow truck operator. <br /> Section 5: <br /> The Police Department is hereby authorized to remove and impound <br /> vehicles from any public street, alley or other public place, or from <br /> private property in any of the following circumstances: <br /> (a) Any vehicle parked in such a position that it constitutes an <br /> obstruction to traffic or is unlawfully parked in any prohibited <br /> or restricted area, or is parked or so used as to endanger or likely <br /> to endanger any user or potential user of any public highway, or <br /> used in violation of the traffic ordinances of the City of Everett <br /> or of any rule or regulation promulgated in connection therewith <br /> by the chief of police acting in conjunction with the City <br /> Council, is hereby declared to be a nuisance. Such nuisance <br /> may be summarily abated by removing the vehicle by or under <br /> the direction of a police officer by means of towing or otherwise. <br /> (b) In the event that an operator of a vehicle is arrested and placed <br /> in custody and is not in condition to drive the vehicle to a <br /> place of safety and there is no other person present who may <br /> properly act as agent for such operator to drive the vehicle to <br /> a place of safety, or the operator of a vehicle is incapacitated <br /> Page 2 <br />
