I + , • • r • • • Section 2: Improvement shall be made of Elm Street from the existing manhole at 51st Street to a point 485 feet South along the center line of Elm Street by the construction of a gravity sewer line including all appurtenances as may be necessary in connection therewith to make a complete improvement, all in accordance with plans and specifications to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. Section 3: That the cost and expenses of said improvement, including all necessary and incidental fees, shall be borne by and assessed against the property within the assessment district herein created. The costs and expenses of the said improvement to be assessed against the property within the district shall be assessed in accordance with the special benefits, derived from the improvement without regard to the zone and termini method of spreading assessments. The City shall not be liable in any manner for any of the costs and expenses of the improvement, except as provided in Chapter 144, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 4: That there is hereby established Local Improvement District No. jp 4 p , which district shall include the following property located in Everett, Snohomish County, Washington, to-wit: Beginning at NE corner of the S2 SW4 SE4 Section 36 T29 R4EWM; thence West 40 feet; thence Southerly and parallel to the East line of the subdivision a distance of 205 feet to the true point of beginning; thence continuing on the same course a distance of 440 feet; to a point on the South line of Section 36, T29, R4EWM; thence West along said line a distance of 175 feet; thence North to a point on the South right-of-way of 51st Street; thence East to the true point of beginning. Section 5: That a special fund is hereby created to be known as "Local Improvement Fund No. 4% ig " which shall consist in the aggregate of the several amounts levied, assessed and collected on the several lots, tracts and parcels of land in said Local Improvement District and the proceeds of the sale of bonds or installment notes in said district for the purpose of defraying the costs and expenses of such improvement. Out of said funds shall be paid the bonds or installment notes, the interest thereon and the entire costs of such improvements. Section 6: The costs and expenses of such improvement shall be defrayed by special assessment payable in twenty (20) equal annual installments with interest thereon at the rate of six per cent (6%) per annum, under the mode of payment by bonds or installment notes as provided by law and the ordinances of the City of Everett.
