• <br /> levy of the excise tax under the definitions and provisions hereinabove set • <br /> forth in subsection B and C of this section, such person shall be liable for only <br /> one excise tax levy, which shall be the highest tax levy for which he could <br /> be held liable. <br /> The excise taxes here in this chapter levied shall be separately <br /> designated and identified on each taxpayer's regular City utility billing as a <br /> tax to be used solely for the operation, maintenance, and capital needs of <br /> the Everett Transit System, and shall be otherwise billed, collected and <br /> accounted for substantially at the same time and in the same manner as services <br /> for other City public utilities, including the right of civil suit for the collection <br /> thereof as a debt. <br /> All proceeds from such transit subsidy excise taxes and all revenues <br /> from the transit system shall be forthwith paid into a fund hereby established <br /> and designated as the "Transit Fund. " Money so received and <br /> deposited in said fund shall be used only for the operation, maintenance <br /> and capital needs of public transportation for the City of Everett. If the <br /> City shall cease operation of a transit system, the tax herein imposed shall <br /> be deemed rescinded as soon as all transit obligations have been met. In <br /> addition to the right of civil suit for collection of debt, it shall be unlawful <br /> for any person served by and billed for any water system to refuse to pay <br /> the transit subsidy excise taxes herein required. Any person who violates the <br /> provisions of this section shall be guilty of a misdemeanor, and, upon <br /> conviction thereof, shall be punished by a fine of not to exceed $300. 00. <br /> Section 5. This ordinance shall be referred to the voters of the <br /> City of Everett in the manner required by law at an election to be held in the <br /> City of Everett on the 4th day of November, 1969, in accordance with all <br /> applicable laws.
