the Premises in violation of law; and to do all other acts which from the character or use <br /> of the Premises may be reasonably necessary to preserve and conserve its value. The <br /> Agency shall maintain the Property as decent, safe, and sanitary housing in good repair <br /> in conformance with the Uniform Property Condition Standards, or such other on-going <br /> property standards as the City may require. <br /> H. Taxes, Assessments, and Encumbrances <br /> The Agency agrees to pay before delinquency all taxes, assessments, and any other <br /> charges affecting the Premises when due, and all encumbrances, charges, and liens, with <br /> interest, on the Premises or any part, subject to the Agency's right to contest such taxes, <br /> assessments and other charges in good faith. <br /> I. Eligibility for Admission <br /> An applicant is eligible for admission to the Project if he or she meets all of the following <br /> criteria: <br /> 1. For HOME-Assisted Units: The applicant meets the income and other requirements <br /> of the HOME Program as set forth in the HOME Regulations and this Loan Agreement <br /> and meets the requirements of any other funding sources providing funds for the <br /> Project, which sources and eligibility requirements have been approved by the City. <br /> 2. For City-Assisted Units: The applicant meets the income eligibility requirements as set <br /> forth in this Agreement, and in the Seattle-Bellevue WA HUD Metro Fair Market Rent <br /> Area Income Limits established by HUD, or such other affordable housing program <br /> income eligibility requirements as the City may designate, such as the income eligibility <br /> requirements of any other funding sources providing funds for the Project, which <br /> sources and eligibility requirements have been approved by the City. <br /> 3. The Agency may determine that an applicant is not eligible for admission if, on the <br /> basis of substantial, factual evidence of that person's prior actions, there is good cause <br /> to believe that the applicant will repeatedly fail to pay rent, will create a substantial <br /> threat to the health and safety of other residents, or will repeatedly breach material <br /> requirements of the lease. Unsubstantiated oral statements will not be deemed <br /> substantial factual evidence. <br /> J. Resident Selection Procedures; Management Plan <br /> The Agency shall rent housing units in the Project to eligible residents, in accordance with <br /> the HOME Regulations and a Management Plan approved by and on file with the City. <br /> The Management Plan shall include at least the following: <br /> 1. Detailed actions to be taken by the Agency to affirmatively market and rent all units in <br /> accordance with HOME Program requirements at 24 CFR§ 92.351 in a manner which <br /> ensures equal access to all persons in any category protected by federal, state, or <br /> local laws governing discrimination, and without regard to any arbitrary factor; <br /> 2.
