6) General management performance, including tenant relations and other <br /> relevant information; <br /> 7) A description of any fiscal or Program difficulties related to the operation of the <br /> Project consistent with the Program requirements; <br /> 8) The Agency shall provide information to the City regarding unit substitution of <br /> HOME assisted "floating units", and filling vacant HOME-assisted units; and <br /> 9) Any Owner certifications required by the City to certify compliance with the <br /> terms of this Loan Agreement. <br /> 4. HOME-Assisted Unit Rent Increases and Utility Allowance Approvals. <br /> Agency shall submit, at least annually, proposed changes in rents for HOME-assisted <br /> units, along with supporting utility allowance documentation, for approval by the City, <br /> in a form acceptable to the City. <br /> 5. Other Reporting Requirements <br /> a. Each such report shall be subject to the approval of the City. <br /> b. The City may perform or cause to be performed audits of any and all phases of the <br /> Agency's activities related to the Project. At the City's request, the Agency shall <br /> provide, at its own expense, an audit of the Project certified by an independent <br /> certified public accountant. <br /> c. Tax Credit Projects—If the project is financed by Low Income Housing Tax Credits, <br /> the Agency shall provide to the City a copy of the annual partnership or limited <br /> liability company annual audit. <br /> d. The City may request any other information that it deems necessary to monitor <br /> compliance with requirements set forth in this Loan Agreement. Such information <br /> shall be provided promptly by the Agency. <br /> e. In addition to the annual report required above, if required by the City, the Agency <br /> shall file with the City an operating report including such information as the City <br /> may reasonably require and submit it at intervals as directed by the city, but in no <br /> case more often than on a monthly basis. <br /> 6. Other Information <br /> The City may request any other information that it deems necessary to monitor <br /> compliance with the requirements set forth in this Agreement. Such information shall <br /> be provided promptly by the Agency. <br /> 7. Inspections <br /> At any time during the term of this Loan Agreement, upon reasonable prior notice to <br /> the Agency and during normal business hours and subject to the legal rights of tenants, <br /> Loan Agreement <br /> Housing Hope Properties <br /> Page 43 of 51 <br />
