VII. RENT RESTRICTION PROVISIONS <br /> Gross monthly rent for the HOME-Assisted Units, shall not exceed the rent limitation as <br /> provided at 24 CFR § 92.252(a), and as amended, and as specified in Section III. C. of this <br /> Loan Agreement. Annual rent limits for HOME-Assisted Units in the Seattle-Bellevue, WA <br /> HUD Metro FMR area are published by the U.S. Department of Housing and Urban <br /> Development at the HOME program website at <br /> https://www.hudexchange.info/programs/home/home-rent-limits/. These limits incorporate <br /> average occupancy per unit and adjusted income assumptions. The Agency shall be <br /> responsible for utilizing the current annually adjusted rent limits. The City shall make a copy <br /> of the current year's rent limits available to the Agency upon written request. <br /> Gross monthly rent for the City-Assisted Units, including tenant-paid utilities, shall not exceed <br /> the rent limitations of the Seattle-Bellevue, WA HUD Metro FMR area as published annually <br /> by the U.S. Department of Housing and Urban Development, with adjustments for the number <br /> of bedrooms in the unit, and for the Area Median Income levels established in this Loan <br /> Agreement. These limits incorporate average occupancy per unit and adjusted income <br /> assumptions. The Agency shall be responsible for utilizing the current annually adjusted rent <br /> limits. The City shall make a copy of the current year's rent limits available to the Agency upon <br /> written request. <br /> If a City-Assisted Unit or a HOME-Assisted Unit also receives a project-based rental subsidy <br /> or the tenant receives a federal or state direct rental subsidy, and the household pays a <br /> contribution toward rent not more than thirty (30%) of the household's adjusted income, then <br /> the maximum rent (i.e., tenant contribution plus rental subsidy) is the rent allowable under the <br /> federal or state rental subsidy program. <br /> Gross monthly rent incorporates an allowance for tenant-paid utilities (excluding telephone <br /> and cable TV), which is deducted to determine the maximum net monthly rent payable by the <br /> tenant. <br /> VIII. ENVIRONMENTAL REVIEW <br /> The Agency shall cause the Owner to include the environmental mitigation recommendations <br /> specified in the NEPA Environmental Review Record approved by Snohomish County, dated <br /> 11/16/17 and the City of Everett, dated March 20, 2018, in the construction plans and contract <br /> documents, as follows. <br /> The following geological, traffic, and noise mitigation and attenuation measures must be <br /> included in all plans, designs, specifications, and written agreements connected with the <br /> HopeWorks Station II project: <br /> Noise <br /> All attenuation and mitigation measures included in the 9/19/17 Environmental Noise <br /> Study and Recommendations and Figure 19 prepared by A3 Acoustics, LLP will be <br /> incorporated into the building design. All design, construction, and bid documents <br /> containing the mitigation/attenuation requirements will be provided to the City of Everett <br /> Housing and Community Development Program Manager for review and approval prior to <br /> Exhibit A <br /> Housing Hope Properties <br /> Page 5 of 7 <br />
