and to pay when due all claims for labor performed and materials furnished <br /> therefore; to comply with all laws affecting the Premises or requiring any <br /> alterations or improvements to be made; not to commit or permit waste <br /> thereof; not to commit, suffer, or permit any act upon the Premises in <br /> violation of law; and to do all other acts which from the character or use of <br /> the Premises may be reasonably necessary to preserve and conserve its <br /> value. <br /> B. Workforce Development Center Operations Manual <br /> The Owner shall provide documentation to the City for approval that <br /> demonstrates how the Workforce Development Center training programs <br /> will meet the following operational criteria: <br /> 1. Detailed actions to be taken by the Owner to affirmatively market in a <br /> manner which ensures equal access to all person in any category <br /> protected by Federal, State, or local laws governing discrimination, and <br /> without regard to any arbitrary factor; <br /> 2. Specific reasonable criteria for determination of program participant <br /> eligibility; <br /> 3. A requirement that eligible participants be selected based on the order <br /> of application, lottery, or other reasonable method approved by the City; <br /> 4. A requirement that eligible applicants be notified of eligibility and, based <br /> on turnover history, be notified of when a program opening may be <br /> available; <br /> 5. A requirement that ineligible program applicants be notified of the <br /> reason for their ineligibility; <br /> 6. Specific procedures through which applicants deemed to be ineligible <br /> applicants may appeal this determination; <br /> 7. A requirement for maintenance of a waiting list of eligible applicants; <br /> and <br /> 8. Prohibition of discrimination against any prospective resident on a basis <br /> of race, religion, ethnic or national origin, gender, sexual orientation, <br /> age, disability, marital status, or any other arbitrary factor in violation of <br /> any State, Federal, or local law governing discrimination. <br /> XII.
