• <br /> . <br /> !I <br /> ' <br /> ASSOCIATED SAND AND GRAVEL REZONE <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. !/gS TS— <br /> i THIS AGREEMENT is made and entered this '/tea day <br /> f <br /> • hof ill <br /> 1985, by Associated Sand and Gravel Company Inc. , said party being <br /> � hereinafter referred to as Owner, and the City of Everett, a municipal • <br /> I corporation under the laws of the State of Washington, hereinafter <br /> referred to as the City; <br /> it <br /> ll <br /> WITNESSETH: <br /> 11 WHEREAS, Associated Sand and Gravel Company Inc. is the owner of a <br /> tract of real property approximately 2.96 acres in size located east of <br /> I � <br /> Upper Ridge Road and south of Madison Street, Everett, Snohomish County, <br /> 1 <br /> Washington, the legal description of which is attached hereto as Exhibit <br /> I <br /> A and incorporated herein by this reference; and <br /> WHEREAS, such zoning and development is adjacent to the existing <br /> I I <br /> Associated Sand and Gravel mining operation which is zoned M-1 Heavy <br /> Manufacturing; and <br /> j WHEREAS, the public health, safety, and welfare would be best <br /> dserved by anticipating the impact of such development and imposing <br /> I I <br /> certain mutually agreed upon standards, conditions and requirements which <br /> shall be documented herein and hereafter considered to be an integral <br /> I part of the zoning restrictions applicable to the property; and <br /> � I <br /> I <br /> WHEREAS, the owner has agreed to develop the aforementioned <br /> property per the Southwest Everett Comprehensive Plan (The Plan) , which <br /> H is incorporated herein by reference in consideration of the City <br /> considering designating the property M-1 and the owner further agrees as <br /> I <br /> part of said consideration that should the City zone the property M-1 , to <br /> lay out, develop, and maintain the property as hereinafter set forth; <br /> 1,1 CONCOMITANT AGREEMENT - 1 <br /> `j 12;50507 00 73 <br /> VOL 1.848 PAGE 0978 <br />
