• ORDINANCE NO./ 41 AN ORDINANCE PROVIDING FOR THE VACATION OF: That portion of Federal Street: Begin at the intersection of the north line of Everett Ave. projected westerly to its intersection with the east line of Federal St. ; thence north 0° 08' east along the east line of Federal Street for 98.67 ft. to the tpob; thence north 0° 08' east along the east line of Federal St. for 35.32 ft; thence north 89° 52' west for 70 ft. to the west line of Federal St. ; thence south 0° 08' west along the west line of Federal St. for 35.32 ft; thence south 89° 52' east for 70 ft. to the tpob, except The City of Everett to retain an easement to maintain and operate all utilities over and across the portion of the street herein petitioned to be vacated. WHEREAS, the owners of more than two-thirds of the private property abutting upon the streets and alleys above described have duly filed a petition with the City Council of the City of Everett praying for vacation of said streets and alleys; and, WHEREAS, said City Council of the City of Everett did by res- olution duly adopted, fix the 8th day of January, 1969 at 10:00 a.m. of said day for the hearing and determination of said petition; and, WHEREAS, due and legal notice of the time and place of said hearing and the determination of said petition has been given by the City Clerk in the manner prescribed by law; and, WHEREAS, at the time and place fixed for hearing, objections , to the vacation of the herein-described streets were heard and discussed; and, WHEREAS, it now appears to the City Council of the City of Everett that a portion of said streets and alleys petitioned to be vacated should be vacated, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: That the street and alley of the City of Everett, County of Snohomish, State of Washington, described as follows, to wit: That portion of Federal Street: Begin at the intersection of the north line of Everett Ave. projected westerly to its in- tersection with the east line of Federal St. ; thence north 0° 08' east along the east line of Federal Street for 98.67 ft. to the tpob; thence north 0° 08' east along the east line of Federal St. for 35.32 ft; thence north 89° 52' west for 70 ft. to the west line of Federal St. ; thence south 0° 08' west along the west line of Federal St. for 35.32 ft; thence south 89° 52' east for 70 ft. to the tpob, except The City of Everett to re- tain an easement to maintain and operate all utilities over and across the portion of the street herein petitioned to be vacated.
