Memo to Planning Commission,re:REVV18-03(Sonrise Christian) June 8,2018 <br /> The Development Agreement was entered into on the 10th of January, 2011, but was never recorded as <br /> required. Subsequent to this Rezone and Development Agreement,the ownership of the various parcels <br /> was no longer under one control.The parcel that was zoned C-1 in 2010 was sold to Sonrise Christian in <br /> 2018,which was unaware that the Development Agreement bound their property to other parcels since <br /> the document was not recorded and did not show up in title search. <br /> In 2012,the parcel that Sonrise Christian bought was rezoned (Ord. Sonrise Christian proposes to use the <br /> site for an expansion of their parking lot,which accesses Airport Road through a different access point. <br /> Based on this change in access,there will be no access to the other lots within the remainder of the <br /> property affected by the Development Agreement. There is no reason for the property to remain a part <br /> of the Development Agreement. <br /> 2 <br />
